PROCEEDINGS OF THE BOARD OF SUPERVISORS OF MITCHELL COUNTY, IOWATuesday, May 5, 2026The Board of Supervisors convened at 8:30 a.m. with all members present. Also, present were Brandon Halsne, Rich Brumm, Aaron Murphy, Tom Rolfes, Ed Byrnes, Lavonne Byrnes, Clarence Kruse, Bob Muller, Denny Howe, Machela Howe, Amanda Baer, Eric Van Deusen, Lynn Hemann, Kurt Christensen, Taylor Hoover, Jeff Hoover, Jim Hoover, and Keith Anderson. The meeting was made available by video via “Go to Meeting”. Motion by Marzen, second by Hendrickson to approve the agenda with omitting item #13 Discussion & Possible Action on Campaign in Courthouse BOS Room. All voted aye.Motion by Hartogh, second by Wherry to approve the minutes of the April 28th meeting. Roll call: all voted aye.County Attorney Murphy will email the board his thoughts on the cupola.County Sheriff Beaver was not available.There was no department head discussion.County Engineer Rich Brumm is finalizing the rock and paint maps. There was excess bridge funding, so Brumm is going to turn in possible bridges. Supervisor Hendrickson asked about possible damage to a road, and Supervisor Frein stated both sides have settled by the Stillwater bridge.Motion by Hartogh, second by Marzen to approve the Recorder's Report for April in the amount of $6,596.04. Roll call vote: all voted aye. Hannah Elliott said today is the first official day with Fidlar and there will be training this afternoon and tomorrow for employees.Motion by Wherry, second by Hendrickson to approve the Treasurer's Report for April in the amount of $3,424,534.91. Roll call vote: all voted aye.The chair opened the public hearing on the Rezoning of Parcel Numbers 10-22-300-012, 10-22-300-014, 10-22-300-015, 10-22-300-027, & 10-22-300-029 from Agricultural District to Arterial Commercial District at 8:45 a.m. All members of the board had numerous phone calls with concerns. Amanda Baer read the Zoning Commission Recommendation, which was to deny the application. Jim Hoover went over their interest as a quarry owner. Kurt Christensen would like to help create a competitive environment and went over concerns from the April 9th commission meeting. Jeff Hoover explained the blasts are not what they used to be and ensure it would not be an eye sore. Lynn Heman and Clarence Kruse shared concerns of a driveway with bad views, and a housing shortage. Ed and Lavonne Byrnes stated the current driveway had been more west, but you couldn't see oncoming vehicles and stated it is hard to trust what is being said after the owner said there would not be commercial on that property. The chair closed the public hearing at 9:46 a.m.Motion by Wherry, second by Hartogh to deny Rezoning of Parcel Numbers 10-22-300-012, 10-22-300-014, 10-22-300-015, 10-22-300-027, & 10-22-300-029 from Agricultural District to Arterial Commercial District. Roll call vote: all voted aye.The chair opened the public hearing for FY26 Budget Amendment at 9:48 a.m. Supervisor Hendrickson received one comment about the increase to non-departmental department. Auditor Foster said reasons for the budget amendment are TIF rebates, emergency preparedness, Medicare, engineering, and interest. There was no discussion amongst the public in attendance. The chair closed the public hearing at 9:51 a.m.Motion by Hartogh, second by Marzen to approve Appropriations Resolution #1362-26. Roll call vote: all voted aye.Wherry reported on senate file webinar, Hendrickson reported on Iowa Workforce, and Marzen reported on Mitchell County Emergency Preparedness. Hartogh and Frein had nothing to report. Received manure management plan updates from Lipson Finisher Farm, Jon Krebsbach Finisher, Ruehlow I Site, Ruehlow III Site, Borderline Buildings LLC-SW Site, Borderline Buildings LLC-Northeast Site, and Iowa Egg Company.
