MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Peter H. Papit and Rafila D. Papit to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for U.S. Bank N.A., its successors and assigns, dated November 8, 2011 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 48126, Page 3 (the “Mortgage”), as affected by a Loan Modification Agreement dated February 1, 2022, and recorded at said Registry of Deeds in Book 69808, Page 94 of which mortgage U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for RCAF Acquisition Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for U.S. Bank N.A., its successors and assigns to U.S. Bank National association dated September 25, 2012 and recorded at said Registry of Deeds in Book 49746, Page 310, and Assignment from U.S. Bank National association to Select Portfolio Servicing, Inc. dated September 3, 2024 and recorded at said Registry of Deeds in Book 70979, Page 60, and Assignment from Select Portfolio Servicing, Inc. to U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for RCAF Acquisition Trust dated July 14, 2025 and recorded at said Registry of Deeds in Book 72286, Page 86, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 117 Charlton Street, Oxford, MA 01540 will be sold at a Public Auction at 10:00 AM on May 19, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:

Oxford, Worcester County, Massachusetts, on the Southerly side of Charlton Street, shown as Lot 1 on a Plan entitled, 'Plan of Land in Oxford, Massachusetts', owned by Charles and Donald Dimock, Scale 1" = 40', dated May 22, 1996, drawn by B C Survey and Engineering Inc., Oxford, Massachusetts, recorded with the Worcester District Registry of Deeds, Plan Book 704, Plan 64, and bounded and described as follows:
Beginning at a point on the Southerly side of Charlton Street at the Northwesterly corner of the herein described premises at an iron pipe as shown on said Plan.
Thence S. 00 degrees 02' 23" West by said Lot 2, a distance of 327.22 feet to an iron pipe set;
Thence S. 75 degrees 38' 03" East by said Lot 2, a distance of 116.48 feet to an iron pipe set;
Thence N. 01 degrees 07' 51" East by said Lot 2, a distance of 162.74 feet to a point;
Thence N. 25 degrees 54' 17" West a distance of 39.33 feet to a point;
Thence S. 76 degrees 42' 4" East at a distance of 42.09 feet to a point;
Thence N. 34 degrees 48' 35" West a distance of 23.99 feet to a point;
Thence N. 12 degrees 31' 28" East by said Lot 2, a distance of 100.00 feet to a point on the Southerly side of Charlton Street;
Thence N. 60 degrees 17' 39" West by said Charlton Street, 38.19 feet to a Worcester County Highway Bound found;
Thence Northwesterly by said Charlton Street and by a curve to the left, the radius of whose arc is 1,170.00 feet a distance of 116.72 feet to the point of beginning.
Containing 40,001 Square feet of land, according to said Plan.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
