PUBLIC NOTICE NOTICE TO BIDDERS CONSTRUCTION OF WELL NO. 3A, CONTRACT A WELL DRILLING MANTUA TOWNSHIP MUA GLOUCESTER COUNTY, NEW JERSEY NEW JERSEY INFRASTRUCTURE BANK PROJECT No. 0810004-005 Notice is hereby given that sealed bids will be received by the Mantua Township MUA for the bid of the following project at 11:00 A.M. prevailing time on June 10, 2026, at the office of the Mantua Township MUA, 401 Main Street, Mantua Township, New Jersey 08051. Bids will be publicly opened and read aloud at 11:00 A.M. prevailing time on said date. The time for preparing bids shall be a minimum of 10 days from Notice to Bidders to receipt of Bids. The project is funded in part by New Jersey Infrastructure Bank financing programs and the successful bidder must comply with all the provisions of N.J.A.C. 7:22-9.1 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED). The scope, purpose and procedures for providing these opportunities are established in N.J.A.C. 7:22-9 (a). The SED advertisement for this project has been provided in accordance with criteria identified in N.J.A.C. 7:22-9.7. The intent of this Contract is to construct a new public production well, designated Well No. 3A, on the existing Well No. 3 site within Mantua Township, New Jersey. The new well shall be screened within the same aquifer (Middle Potomac-Raritan-Magothy Aquifer) and at similar intervals as the existing Well No.3, and shall be capable of producing a minimum of 250 gallons per minute. Contract "A" work includes well drilling, geophysical logging, well development, grouting and sealing, disinfection, and pump testing and water quality testing in accordance with regulatory requirements. Building modifications, site work, water main construction, and mechanical / electrical/SCADA improvements are not included in this Contract and will be bid separately. The Issuing Office for the Bidding Documents is the office of the Engineer: Sickels & Associates, 833 Kings Highway, Woodbury, New Jersey 08096, (856) 848-6800. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays, and may obtain copies of the Bidding Documents from the Issuing Office as described within this notice. Printed copies of the Bidding Documents may be obtained at this address upon payment of $285.00 for each set. Electronic copies of the Bidding Documents may be obtained from the Issuing Office by paying a fee of $50.00 for each set. Checks should be made payable to Sickels & Associates, Inc. If contract documents are to be mailed, add twenty-five dollars ($25.00) to the cost of the documents. NO REFUND SHALL BE MADE FOR RETURN OF THESE DOCUMENTS. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. This project is being bid in accordance with local public contract bid laws and Bidders shall comply with the Local Contracts Law, N.J.S.A. 40A:11-1 et seq. The project sponsor has provided SED utilization public notification, at least 10 days prior to advertisement in accordance with N.J.A.C. 7:22-9.6 (a). Bids must be submitted on the forms provided within the documents in the manner designated therein. Bids must be enclosed in a sealed envelope bearing the bidder's name and address labeled "BID FOR CONSTRUCTION OF WELL NO. 3A, CONTRACT "A" WELL DRILLING" and addressed to the Mantua Township MUA, 401 Main Street, Mantua Township, New Jersey 08051, Attention: Maria Vacarino, Accounts Receivable Administrator. If forwarded by mail, the sealed envelopes containing the bid must be enclosed in another envelope addressed to the Mantua Township MUA. Bids must be accompanied by a Certificate of Surety from an acceptable surety and a bid security in the form of a certified check, cashier's check or bid bond payable to the Mantua Township MUA in the amount of ten percent (10%) of the total bid amount, but not in excess of $20,000.00. Certificate of Surety shall be written by a surety company listed on the United States Treasury Department Circular 570 and the New Jersey List of Approved Surety Companies. All bidders are required to provide a copy of the contractors and subcontractors business registration certificate(s) issued by the Department of the Treasury in accordance with Section 1 of P.L. 2004, c.57 (C.52:32-44). All Contractors and subcontractors must also comply with the "Public Works Contractor Registration Act" (P.L. 2203, c.91); and P.L. 1977, c.33 (Disclosure of Ownership). The successful bidder shall also comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964. Pursuant to N.J.A.C. 10:5-33: "Bidders are required to comply with the requirements of P.L. 1975, c.127." This includes compliance with Affirmative Action requirements pursuant to Public Law 1975 C. 127 (N.J.A.C. 17:27) as revised and amended to date. The successful Bidder must also furnish an Initial Project Manning Report (AA201) upon execution of the Agreement. The successful bidder must furnish a Performance Bond and Payment Bond, each in the amount equal to one hundred percent (100%) of the contract price. Said bonds must be in a form acceptable to the Mantua Township MUA and be issued by a surety authorized to do business in the State of New Jersey. The Contracts, if awarded, will be to the lowest responsible bidder whose bid proposal conforms to the requirements set forth in the Contract Documents. The Mantua Township MUA will award the Contract or reject the bids within sixty (60) municipal days after the date of the bid opening. Should there be any reason the contract cannot be awarded within the specified period, the time may be extended by mutual agreement between the Mantua Township MUA and the bidder. The contract shall not be approved until a favorable eligibility determination has been made by the NJDEP per requirements of the New Jersey Infrastructure Bank. Consideration of SED utilization during the bid process for this project will be applied, in accordance with the provisions of N.J.A.C 7:22-9.10. Contractor is advised of the responsibility to file an annual disclosure statement on political contributions with the New Jersey Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-20.13 (P.L. 2005, c271, s3) if the contractor receives contracts in excess of $50,000.00 from public entities in a calendar year. Awards will be made only to socially and economically disadvantaged business concerns that are certified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemed appropriate by the Office as eligible minority businesses or female businesses. The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements, in accordance with provisions of N.J.A.C 7:22-9.7(b). In accordance with the provisions of N.J.A.C 7:22-3.17(d) this contract or subcontract is expected to be funded by in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Bank. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies, or employees is, or will be a party to this contract or subcontract or any lower tier contractor or subcontract. This contract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.A.C 7:22-3.17(f) and N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a) 24 and 4.17(a) 24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. The attention of the bidder is called particularly to the program requirements with respect to environmental and cultural protection, goals of SED utilization, conditions of employment to be observed, and to minimum wage rates to be paid as required by the contract documents. N.J.A.C. 7:22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10 percent be established for the award of contracts to small business concerns owned and controlled by one or more socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount of all contracts for building, materials and equipment, or services for a construction project. The project sponsor has identified that the SED utilization goal for this project is 10% of the awarded project construction cost. The 10 percent SED utilization attainment requirement shall be accomplished in accordance with N.J.A.C. 7:22-9.3(b) with regard to the solicita tion of bids. Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) applies an Build America Buy America/ American Iron and Steel requirement to this project. All iron and steel products used in this project must be produced in the United States. After the award of a contract (if awarded) and prior to the start of work, a preconstruction meeting shall be scheduled by the recipient. The recipient, the responsible engineer, the environmental and construction inspectors, the contractor and one or more representatives of the Department must be present at the preconstruction meeting. The Mantua Township MUA and the Engineer reserve the right to require a complete financial and experience statement from the prospective bidders showing that they have satisfactorily completed work of the nature required before furnishing proposal forms or specifications, or before awarding the contract. The Mantua Township MUA reserves the right to reject any and all bids in whole or in part, and to waive any informalities or minor defects therein, should it be deemed in the best interest of the Mantua Township MUA. The right is also reserved to increase or decrease the quantities specified in the manner designated in the specifications.
