TOWN OF BOONTON ORDINANCE 3-26 NOTICE OF PENDING AFFORDABLE HOUSING ORDINANCE AND SUMMARY Notice is hereby given that the following ordinance was introduced and passed on first reading at an Official Meeting of the Governing Body of the Town of Boonton on the 17th day of February, 2026, and the same shall come up for a public hearing and final passage at an Official Meeting of the Governing Body to be held on Monday, March 16, 2026, at 7:00 P.M. in the Municipal Building at 100 Washington Street, Boonton, New Jersey 07005, at which time any persons interested shall be given the opportunity to be heard concerning said Ordinance: Ordinance 3-26 “AN ORDINANCE OF THE TOWN OF BOONTON, COUNTY OF MORRIS, STATE OF NEW JERSEY REPEALING AND REPLACING CHAPTER 70 “AFFORDABLE HOUSING” AND CHAPTER 300, ARTICLE XVIII §300-85 “AFFORDABLE HOUSING MANDATORY SET-ASIDE” OF THE CODE OF THE TOWN OF BOONTON TO ADDRESS THE REQUIREMENTS OF THE FAIR HOUSING ACT AND TO COMPLY WITH THE TOWN'S ROUND FOUR AFFORDABLE HOUSING OBLIGATIONS.” This ordinance updates the Towns's existing general affordable housing code and mandatory set-aside ordinance to comply with recent state statutory and regulatory changes addressing affordable housing obligations at the local level. This ordinance integrates the applicable updated provisions of the Uniform Housing Affordability Controls (UHAC) promulgated by the New Jersey Housing and Mortgage Finance Agency at N.J.A.C. 5:80-26 et seq, the amended Fair Housing Act at N.J.S.A. 52:27D-301 et seq., the Fair Housing Act Regulations promulgated by the Department of Community Affairs, Division of Local Planning Services (“LPS”) at N.J.A.C. 5:99 et seq., and statutorily upheld existing regulations of the former Council on Affordable Housing (“COAH”) at N.J.A.C. 5:93 and 5:97. This ordinance further updates the Town's municipal-wide mandatory set-aside ordinance to increase the affordable housing set aside for any future rental developments from 15% to 20% in accordance with the requirements of N.J.S.A. 52:27D-329.9 of the amended Fair Housing Act.
