TOWN OF BOONTON ORDINANCE NO 2-26 NOTICE OF PENDING ORDINANCE UPDATE AND SUMMARY Notice is hereby given that the following ordinance was introduced and passed on first reading at an Official Meeting of the Governing Body of the Town of Boonton on the 17th day of February, 2026, and the same shall come up for a public hearing and final passage at an Official Meeting of the Governing Body to be held on Monday, March 16, 2026, at 7:00 P.M. in the Municipal Building at 100 Washington Street, Boonton, New Jersey 07005, at which time any persons interested shall be given the opportunity to be heard concerning said Ordinance: Ordinance 2-26 “ORDINANCE TO AMEND THE DIVISION STREET REDEVELOPMENT PLAN TO IMPLEMENT CHANGES IN ACCORDANCE WITH THE 2025 ROUND FOUR HOUSING ELEMENT AND FAIR SHARE PLAN”. This Ordinance amends prior Ordinance 31-21 of the Town Council, which created the Division Street Redevelopment Plan and established zoning and land use standards for the properties located at Block 70, Lots 1, 2, 3, 5, 21.01, and 21.02, and Block 1, Lots 1, 2, 5, 5.01, 5.02, 6, 6.01, 6.02 (including former lot 6.03), 7, 8, 9, 10, 11, 12, 13, 14, and 15 in the Town of Boonton. This Ordinance proposes to increase the affordable housing set aside requirements for any projects having a residential component within the Division Street Redevelopment Plan by increasing the affordable housing set aside for any residential rental projects and any mixed-use residential rental projects from 15% to 20% in accordance with the requirements for any Highlands Area communities set forth in N.J.S.A. 52:27D-329.9 of the amended Fair Housing Act. This proposed Ordinance requires all projects with a residential component pursued under the Division Street Redevelopment Plan resulting in five or more residential units to include an affordable housing set-aside of a minimum of 20 percent, regardless of whether the units are for rent or for sale. Additionally, the Ordinance clarifies that the applicable Uniform Housing Affordability Controls and applicable requirements of Chapter 70 – Affordable Housing of the Town of Boonton Code shall be those which are in place at the time of a redevelopment agreement.
