Mount Arlington Borough COUNTY OF MORRIS, STATE OF NEW JERSEY NOTICE OF ORDINANCE ORDINANCE 03-2026 NOTICE IS HEREBY GIVEN that the following Ordinance was introduced by the Governing Body of the Borough of Mount Arlington, in the County of Morris, State of New Jersey, at a regular meeting held on February 3, 2026: AN ORDINANCE OF THE BOROUGH OF MOUNT ARLINGTON, COUNTY OF MORRIS, STATE OF NEW JERSEY, ESTABLISHING THE HOWARD BOULEVARD TRAIN STATION INCLUSIONARY ZONE The purpose of this Ordinance is to establish a new Howard Boulevard Train Station Inclusionary Zone in the Borough of Mount Arlington's Land Development Ordinance (new \c 17-28.16), creating a realistic opportunity for the construction of low- and moderate-income housing on available land in order to address the Borough's fair share housing obligation under the New Jersey Fair Housing Act and its constitutional obligations to provide affordable housing. The Ordinance provides as follows: Location. The zone is comprised of Block 70.01, Lot 1, located on Howard Boulevard. Permitted Uses. Principal permitted uses include multifamily apartment buildings and mixed-use buildings with retail, service, and/or office uses on the ground floor and apartments on upper floors. Permitted accessory uses include off-street parking and loading facilities, signage, and structures ancillary to permitted uses. Area and Bulk Standards. The zone establishes the following bulk standards: minimum lot size of 3 acres; minimum lot width of 200 feet; maximum building height of four stories/50 feet; minimum front yard of 25 feet; minimum side yard of 10 feet each; minimum rear yard of 25 feet; and maximum lot coverage of 75%. All other regulations and requirements of the OB Zone not specifically addressed herein shall remain in effect. Affordable Housing Requirements. Maximum residential density shall not exceed 20 dwelling units per acre. A minimum 20% set-aside for affordable units is required regardless of tenancy, generating no fewer than 16 affordable housing units. Said Ordinance will be further considered for final passage after a Public Hearing to be held on Tuesday, March 3, 2026, at 7:00 p.m., at the Municipal Building, Mount Arlington, New Jersey. Copies of this Ordinance are available in the office of the Borough Clerk for members of the general public who request the same.
