NOTICE OF ADOPTION At a Regular Meeting of the Town Board of the Town of Queensbury held on April 6th, 2026 at the Queensbury Center, Town of Queensbury, 742 Bay Road, Queensbury, New York, the following was adopted and is subject to permissive referendum: RESOLUTION AUTHORIZING AWARD OF BID TO ROZELL INDUSTRIES, INC. FOR BOILER REPLACEMENT PROJECT AT HIGHWAY GARAGE RESOLUTION NO.: 135, 2026 INTRODUCED BY: Mr. Timothy McNulty WHO MOVED ITS ADOPTION SECONDED BY: Mr. Scott Gushlaw WHEREAS, by Resolution No.: 452,2013, the Queensbury Town Board authorized establishment of the Highway Facility Improvements Capital Project Fund No.: 202, and WHEREAS, by Resolution No.: 323,2025, the Town Board authorized the Town Purchasing Agent to publish an advertisement for bids for the replacement of two (2) boilers at the Town’s Highway Department Building (Project) as set forth in bid specifications prepared by C.T. Male Associates and/or the Purchasing Agent, and WHEREAS, General Municipal Law §103 requires that the Town advertise for and award the bid to the lowest responsible bidder meeting New York State statutory requirements and the requirements set forth in the Town’s bid documents and specifications and accordingly the Town Purchasing Agent published an advertisement for bids and on March 27th, 2026 duly opened all received bids, and WHEREAS, the Purchasing Agent and C. T. Male Associates have reviewed the bids and recommended that the Town Board authorize the bid award to the lowest, responsible bidder, Rozell Industries, Inc., for the amount of $98,125, and WHEREAS, the Town Board wishes to fund this Project from Capital Reserve No. 64 and in accordance with New York State General Municipal Law §6(c), the Town Board is authorized to withdraw and expend funds from Capital Reserve No.: 64 subject to permissive referendum, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby awards the bid for the replacement of two (2) boilers at the Town’s Highway Department Building (Project) to the lowest, responsible bidder, Rozell Industries, Inc., for an amount not to exceed $98,125 to be paid from Capital Construction Account No.: 202-1620-2899, and BE IT FURTHER, RESOLVED, that such expenditures are for a specific capital project for which Capital Reserve Fund No.: 64 was established and therefore the Town Board authorizes that funding shall be by a $98,125 transfer from Capital Reserve Fund No.: 64 to Highway Facility Improvements Capital Project Fund No.: 202, and BE IT FURTHER, RESOLVED that the Town Board further authorizes the Town Budget Officer to take any actions needed to amend the Town Budget and increase appropriations and revenues as follows: * Revenue Acct No. – 202-0000-55031 (Interfund Revenue) $98,125; * Expense Acct No. – 202-1620-2899 (Capital Construction) $98,125; * Increase Appr 001-9950-9030-0064 Transfer to Cap Project $98,125; and BE IT FURTHER, RESOLVED, that the Town Board further authorizes the Town Supervisor to execute any needed agreement between the Town and Rozell Industries, Inc., in form acceptable to the Town and/or any other documentation and the Town Supervisor, Facilities Manager, Highway Superintendent, Town Budget Officer and/or Town Purchasing Agent to take any actions needed to effectuate this Resolution, and BE IT FURTHER, RESOLVED, that this Resolution is subject to a permissive referendum in accordance with the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town Clerk to publish and post such notices and take such other actions as may be required by law.
