ERIE COUNTY LEGAL NOTICE NOTICE OF HEARING ZONING BOARD OF APPEALS TOWN OF LANCASTER To be held Thursday, April 9, 2026, at 7:00 P.M., Local Time, in the Town Board Chambers, in the Lancaster Town Hall, 21 Central Avenue, Lancaster, New York. The meeting will be recorded. The items for consideration by the Zoning Board of Appeals at this meeting are: 1.) The petition of Michael & Jennifer Backes, 18 Kevwood Lane, Lancaster, New York 14086, for one [1] variance for the purpose of constructing a rear patio roof on the principal structure on premises owned by the petitioners at 18 Kevwood Lane, Lancaster, New York, to wit: A variance from the requirements of Chapter 400, Zoning, Section 14, Subsection D, Schedule B of the Code of the Town of Lancaster. The request calls for constructing a rear patio roof on the principal structure with a 25-foot, 4-inch rear yard setback. Chapter 400, Zoning, Section 14, Subsection D, Schedule B of the Code of the Town of Lancaster requires a minimum rear yard setback of 35-feet from the property line or if an easement exists, from the edge of the easement (whichever is more restrictive). The petition of Eileen Rutkowski, 1 Matthews Drive, Lancaster, New York 14086, for one [1] variance for replacing an existing non-conforming fence in a required front yard setback on premises owned by the petitioner at 1 Matthews Drive, Lancaster, New York, to wit: A variance from the requirements of Chapter 400, Zoning, Section 34, Subsection C of the Code of the Town of Lancaster. The request calls for installing a 6-foot tall fence in a required front yard setback. Chapter 400, Zoning, Section 34, Subsection C of the Code of the Town of Lancaster requires within nonindustrial districts, no fence or wall, other than a necessary retaining wall, over 3-feet in height, shall extend into the front yard of any lot. The petitioner, therefore, requests a 3-foot variance. 5.) The adjournment of the rehearing of the petition of Charles Grieco, Bond, Schoeneck & King, 200 Delaware Avenue, Buffalo, New York 14202, calling upon the Zoning Board of Appeals for an interpretation concerning the Final Notice of Violation/Order of Remedy of the premises owned by Majestic Pools, Inc. located at 4370 Walden Avenue, Lancaster, NY 14086. Pursuant to Chapter 400, Zoning, Section 4 of the Code of the Town of Lancaster and Section 267-a (4) of New York State Town Law, the Board shall hear and decide appeals where it is alleged that there is an error or misinterpretation in any order, requirement, decision or determination by any administrative official of the Town charged with the enforcement of the Town Law. The Board may reverse, modify or affirm, in whole or in part, any such appealed order, requirement, decision or determination appealed from and may make such order, requirement, decision or determination as in its opinion ought to be made in strictly applying and interpreting the provisions of this ordinance, and for such purposes shall have all powers of the officer from whom the appeal is taken. The Town of Lancaster Code Enforcement Officer, hereby appeals to the Zoning Board of Appeals of the Town of Lancaster for an interpretation of the Final Notice of Violation/Order to Remedy of Majestic Pools, pursuant to the authority granted in Chapter 400, Zoning, Section 4 of the Code of the Town of Lancaster and Section 267-a (4) of New York State Town Law.
