ERIE COUNTY LEGAL NOTICE AMENDED SETTLEMENT OF CONSCIOUS PAIN AND SUFFERING CLAIM CITATION File No. 2017-4637/C; SURROGATE'S COURT ERIE COUNTY CITATION; THE PEOPLE OF THE STATE OF NEW YORK, By the Grace of God Free and Independent, TO: Estate of Shlaine Freeland Sr., c/o Sonya M.Freeland Voluntary Administrator; and to Any and all persons who are or who claim to be heirs at law next ofkin, distributees of the decedent named below, if any such there be, all ofwhom and all of whose names, ages, places of residence and post offices addresses are unknown to Petitioner and cannot after due diligence used be ascertained; and to Jennifer Flannery, Esq - Erie County Public Administrator; and Hon. Freeland domiciled at 166 Goulding Avenue, Buffalo NY 14208, why the claims of the estate, as set forth herein, should not be settled and compromised in the amount of $285,000.00 and why, the proceeds of the settlement should not be allocated 100% to conscious pain and suffering and 0% to the claim for wrongful death, and why, attorney fees in the amount of $7 500.00, plus disbursements in the amount of $1,251.35 should not be fixed and paid to Magavern Magavern Grimm LLP; why attorney fees in the amount of $63 333.33, plus disbursements in the amount of $7,771.07, should not be fixed and paid to The Dempsey Firm· why, fees in the amount of $2,872.64, plus disbursements in the amount of $0.00, should not be fixed and paid to Precision Resolution LLC; why the net proceeds of the claim for conscious pain and suffering, less fees to Medicaid and Guardian Ad Litem fees should not be payable in the following percentages and amounts: Velynka S.
