Project Description:

The applicant proposes to disturb approximately 1.31 acres of regulated adjacent area associated with the replacement of approximately 850 linear feet of existing 20-inch diameter natural gas pipeline with approximately 850 linear feet of new 24-inch diameter natural gas pipeline. Temporary impacts to the regulated adjacent area will include excavation to install the new natural gas pipeline and the temporary placement of timber matting for construction access. Approximately 350 linear feet of pipeline will be installed via conventional bore north and south of Willet Road in the Towns of Lackawanna and Hamburg, Erie County, and approximately 500 linear feet will be installed via horizontal directional drilling underneath the New York State Thruway. The project will result in approximately 3.35 acres of ground disturbance and all work will occur within existing right-of-way.

SEQR is preempted by federal law.

State Historic Preservation Act (SHPA) Determination

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
