NOTICE OF PUBLIC HEARING

TOWN OF POMFRET

APRIL 15, 2026

AT A REGULAR MEETING OF

THE TOWN BOARD OF THE TOWN

CHAUTAUQUA, NEW YORK, held at

the Town Hall in said Town on the 11th

day of March, 2026.

In the Matter of the Establishment 

of Sewer District No. 6 , in the Town of Pomfret, 

County of Chautauqua, State of New York

 WHEREAS, a written Petition dated March 4, 2026, has been submitted in due form by Daniel W. Pacos and Kimberly Joy Pacos, property owners containing the required signatures, which has been presented and filed with the Town Board of the Town of Pomfret, County of Chautauqua, State of New York, for the establishment of a Town Sewer District, to be known as Sewer District No. 6, which is bounded and described on Exhibit A attached hereto and made a part hereof; and

WHEREAS, the improvements proposed consist of the construction and maintenance of a sewer system to serve the District in accordance with a certain map plan and report prepared by CPL Engineers dated October, 2025, made a part of such Petition and heretofore adopted by this Town Board, and on file in the office of the Town Clerk of said Town; and

WHEREAS, it is the intention of the Petitioners to construct said sewer system at their own expense, to transfer said sewer system to the Town, when completed, without any consideration.

NOW THEREFORE BE IT

ORDERED, that a meeting of the Town Board of the Town of Pomfret will be held at the Town Hall, 9 Day Street, Fredonia, New York on April 15, 2026, at 6:15 p.m. on said day, to consider said Petition, and to hear all persons interested in the subject thereof, concerning the same, and for such other action on the part of said Town Board with relation to the premises.

TOWN OF POMFRET SEWER DISTRICT

All that tract or parcel of land situated in the Town of Pomfret, County of Chautauqua, State of New York, being described as follows:

Beginning at the intersection of the easterly extension of the northerly line of tax account number 112.00-6-8 and the centerline of Johnson Street (49.5 feet wide right-of-way); thence,

 1. Southerly, along the centerline of Johnson Street, a distance of 141 feet, more or less, to the easterly extension of the southerly line of ta account number 112.00-3-8; thence,
 2. Westerly, along the easterly extension of the southerly line of tax account number 112.00-3-8 and the southerly line of tax account number 112.00-3-8, a distance of 1,734 feet, more or less, to the westerly line of tax account number 112.00-3-8; thence,
 3. Northerly, along the westerly line of tax account number 112.00-3-8, a distance of 131 feet, more or less, to a northerly line of tax account number 112.00-3-8; thence,
 4. Easterly, along a northerly line of tax account number 112.00-3-8, a distance of 947 feet, more or less, to a northerly line of tax account number 112.00-3-8; thence,
 5. Northerly, along a easterly line of tax account number 112.00-3-8, a distance of 33 feet, more or less, to a northerly line of tax number 112.00-3-8; thence,
