NASSAU COUNTY NOTICE OF HEARING ON PROPOSED LOCAL LAW VILLAGE OF GARDEN CITY, NY NOTICE IS HEREBY GIVEN, that the Board of Trustees of the Incorporated Village of Garden City, New York, will hold a public hearing at the Village Hall, 351 Stewart Avenue, in said Village as well as via Zoom at 7:30 p.m. on the 19th day of March 2026, upon the following: A Local Law to Amend Chapter 38 of the Village Code with regard to Residential Subdivisions in the Village of Garden City. The Code of the Village of Garden City Chapter 38. “Planning Commission: Subdivision Review” shall be amended as follows: Section 1. Section 38-3. “Definitions.” shall be amended to delete the term “Minor Subdivision.” Section 2. Section 38-3. “Definitions.” shall be amended so that the term “subdivision” shall read: SUBDIVISION The division of any parcel of land into two or more lots, blocks or sites, with or without streets or highways. A transfer of property between adjacent property owners that does not create an additional lot and does not reduce the size of any existing lot area, dimension or setback below the minimum requirement for the zoning district in which the property is located shall not be considered a subdivision within the meaning of this chapter. Section 3. Section 38-4. “Planning Commission approval required for subdivisions.” shall be amended so as to amend Section 38.4.E. to read as follows: E. Subdivision approval is intended to allow limited division of land where consistent with neighborhood scale, established development patterns, and the planning intent of the Comprehensive Plan and Village Code. Section 4. Effective Date. This Local Law shall take effect immediately upon filing in the office of the New York Secretary of State in accordance with the Municipal Home Rule Law.
