(CP 8154) SYNOPSIS OF DETERMINATIONS AND FINDINGS OF GEOFF MASCARO, ESQ. AS HEARING OFFICER DULY DEISGNATED BY THE COMMISSIONER OF THE SUFFOLK COUNTY DEPARTMENT OF PUBLIC WORKS PURSUANT TO SECTION 204 OF THE NEW YORK STATE EMINENT DOMAIN PROCEDURE LAW Pursuant to New York State Eminent Domain Procedure Law Section 201, on March 6, 2026, a hearing regarding the above-entitled project was held to inform the public about said project and to review the public use to be served by the project and to determine the impact of the project upon the environment and upon the residents of the locality where said project will be constructed. On March 5, 2026, the Condemnor, to wit: The County of Suffolk, by GEOFF MASCARO, Esq. as Hearing Officer duly designated by the Commissioner of the Suffolk County Department of Public Works made its Findings and Determinations based upon said hearing. Furthermore, on May 14, 2026, said Findings and Determinations, together with the Minutes and Exhibits of the Hearing, will be duly filed in the Office of the Suffolk County Clerk, the Office of the Clerk of the Suffolk County Legislature and the Administrative Offices of the Suffolk County Department of Public Works. A copy of the Findings and Determinations will be forwarded to any interested person without cost upon written request to: Clerk of the Suffolk County Legislature William Rogers Bldg. PO Box 6100 Hauppauge, NY 11788-0099 Under Section 207 of the New York State Eminent Domain Procedure Law, there are thirty (30) days from the completion of the Condemnor's newspaper publication requirement to seek judicial review of the Condemnor's Determinations and Findings. Under Sections 207 and 208 of the New York State Eminent Domain Procedure Law, the exclusive venue for Judicial Review of the Condemnor's Determinations and Findings is the Appellate Division of the Supreme Court in the Judicial Department where any part of the property to be condemned is located. The synopsis of said Findings and Determinations of GEOFF MASCARO, as Duly Designated Hearing Officer by the Commissioner of the Suffolk County Department of Public Works, is as follows: a. That the proposed project, as recommended by the Suffolk County Department of Public Works is an acceptable alternative for the proposed project. b. That the public, use, benefit, or purpose to be served by the proposed public project is to install sewer infrastructure required to realize the public benefit of the Port Jefferson Station area development, business, investment and environmental improvements. c. That the approximate location of this project is at No #, Vacant Land, Hallock Avenue, Hamlet of Port Jefferson Station, Town of Brookhaven, Suffolk County, New York with the Suffolk County tax map number for this parcel being District 0200 Section 160.00 Block 06.00 Lot 018.000. d. Various project designs and locations were considered with the selected site being the most cost effective alternative. e. The reason for selecting this location amongst various alternatives considered for this project was that they were found to be inadequate to meet project needs and goals. f. That the general effect of the proposed project will not result in any significant adverse environmental impacts and is therefore acceptable from an environmental impact standpoint because: 1) The impacts that may be reasonably expected to result from the proposed project were compared against the criteria in Section 617.7 of Title 6 NYCRR, which sets forth thresholds for determining significant effect on the environment, and as demonstrated in the Environmental Assessment Form; 2) The proposed project does not appear to significantly threaten any unique or highly valuable environmental or cultural resources as identified in or regulated by the Environmental Conservation Law of the State of New York or the Suffolk County Charter and Code; 3) The project site does not appear to suffer from any severe environmental development constraints (limiting soil properties; high groundwater or unmanageable slopes); 4) There is sufficient permitted capacity at the Suffolk County Sewer District #2 Tallmadge to accommodate the increased wastewater flow that would result from this proposed action; 5) The proposed project appears to be consistent with the recent Town of Brookhaven's planning initiatives including the 2014 Port Jefferson Station Commercial Hub Study and the planned Port Jefferson Station Blight Study Urban Renewal Plan; 6) Any future land development that occurs within the proposed Suffolk County Suffolk County Sewer District # 2 Tallmadge extension area will be subject to the Town of Brookhaven's land use approvals and environmental review requirements; 7) Commercial parcels within the proposed sewer expansion will require testing and abandonment of their existing sanitary systems, in accordance with the requirements set forth by the Suffolk County Department of Health Services; 8) All required regulatory permits/approvals will be obtained prior to construction of the proposed project. f. That the general effect of the proposed project on the residents of the locality is positive because it will expand the sewer district thereby reducing risk of groundwater contamination. g. That another relevant factor in approving this project is the fact that this project will further promote the goal of mitigating groundwater contamination by sanitary wastewater in Suffolk County.
