(Termination of Parental Rights)
TO: DEFENDANTS, ATTORNEYS, GAL & HORRY COUNTY DSS
YOU ARE HEREBY SUMMONED and served with the Amended Complaint and Complaint for Termination of Parental Rights in and to the minor children in this action, the original of which has been filed in the Office of the Clerk of Court, Horry County, on July 12, 2025, a copy of which will be delivered to you upon request; and to serve a copy of your Answer to the Complaint upon the undesigned attorney for the Plaintiff at 9630 Scipio Lane, Office A139, Myrtle Beach, South Carolina 29588 within thirty (30) days following the date of service upon you, exclusive of the day of such service; and if you fail to answer the Complaint within the time stated, an Affidavit of Default will be entered against you and the Plaintiff will proceed to seek to terminate your parental rights to the above-captioned children. .
YOU ARE FURTHER NOTIFIED AND SUMMONED TO APPEAR as follows:
1. A Hearing pursuant to South Carolina Code Section 63-7-40 has been set for June 25, 2026 at 1:00 pm. You are hereby notified to be present at this time at the Horry County Family Court, located at 1301 2nd Avenue, Conway, South Carolina 29526.
2.YOU ARE FURTHER NOTIFIED that: (1) the guardian ad litem (GAL) who is appointed by the court in this action to represent the best interests of the child(ren) will provide the family court with a written report that includes an evaluation and assessment of the issues brought before the court along with recommendations; (2) the GAL's written report will be available for review twenty-four (24) hours in advance of the hearing; (3) you may review the report at the GAL Program county office.
PLEASE TAKE FURTHER NOTICE that, as a named Defendant in this action, you have the right to be present and represented by an attorney. If you cannot afford an attorney, the court will appoint an attorney to represent you. It is your responsibility to contact the Clerk of Court's Office, 1301 Second Avenue, Conway, SC 29528 to apply for appointment of an attorney to represent you if you cannot afford an attorney. PLEASE FILL OUT AND TAKE WITH YOU THE ATTACHED AFFIDAVIT OF INDIGENCY AND APPLICATION FOR COUNSEL WITH YOU TO THE CLERK'S OFFICE. You must do so before the hearing date.
