ALL THAT LOT, PIECE OR PARCEL OF LAND, TOGETHER WITH THE BUILDINGS AND IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE COUNTY OF BERKELEY, STATE OF SOUTH CAROLINA, AND KNOWN AND DESIGNATED AS LOT 18, IN BLOCK Q, OF BEVERLY HILLS SUBDIVISION, AS SHOWN ON A PLAT OF SAID SUBDIVISION, MADE BY W.H. MATHANY, RLS, DATED MAY 29, 1958, AND RECORDED IN THE OFFICE OF THE CLERK OF COURT FOR BERKELEY COUNTY, SOUTH CAROLINA, IN PLAT BOOK L, PAGE 140, ON THE 7TH DAY OF NOVEMBER, 1958, AND AS SHOWN ON A REVISED PLAT MADE BY THOMAS E. YOUNG, SR., RLS, DATED JUNE 7, 1966, AND RECORDED IN PLAT BOOK R, PAGE 39.
BEING THE SAME PROPERTY CONVEYED TO MARY A HENSLEY (A ONE HALF INTEREST) BY DEED OF ROY LEE HENSLEY DATED MAY 12, 1983 AND RECORDED JUNE 8, 1983 IN BOOK A511 AT PAGE 298, IN THE OFFICE OF THE REGISTER OF DEEDS FOR BERKELEY COUNTY, SOUTH CAROLINA.
SUBSEQUENTLY, ROY LEE HENSLEY PASSED AWAY AND HIS INTEREST IN THE SUBJECT PROPERTY WAS PASSED TO MARY A HENSLEY PURSUANT TO THE WILL OF ROY LEE HENSLEY AND BY PROBATE OF ESTATE FILE NO 1999ES08-135. SEE ALSO DEED OF DISTRIBUTION RECORDED MARCH 25, 1999 AND RECORDED MARCH 25, 1999 IN BOOK 15888 AT PAGE 0296, IN THE OFFICE OF THE REGISTER OF DEEDS FOR BERKELEY COUNTY, SOUTH CAROLINA.
THEREAFTER, MARY A HENSLEY CONVEYED THE SUBJECT PROPERTY TO MARY A MARSH BY QUIT CLAIM DEED DATED SEPTEMBER 23, 2003 AND RECORDED OCTOBER 24, 2003 IN BOOK 03652 AT PAGE 00307, IN THE OFFICE OF THE REGISTER OF DEEDS FOR BERKELEY COUNTY, SOUTH CAROLINA.
THEREAFTER, MARY A MARSH (F/K/A MARY A HENSLEY) CONVEYED THE SUBJECT PROPERTY TO MARY A MARSH AND WILLARD RAY MARSH. AS JOINT TENANTS AND NOT AS TENANTS IN COMMON, BY QUIT CLAIM DEED DATED AUGUST 3, 2017 AND RECORDED AUGUST 14, 2017 IN BOOK RB 2537 AT PAGE 177, IN THE OFFICE OF THE REGISTER OF DEEDS FOR BERKELEY COUNTY, SOUTH CAROLINA. SUBSEQUENTLY MARY A MARSH FKA MARY A HENSLEY PASSED AWAY AND FULL TITLE PASSED TO WILLARD RAY MARSH BY OPERATION OF LAW.

TERMS OF SALE: For cash. Interest at the current rate of 5.99% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Special Referee for Berkeley County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Thirty (30) days, the Special Referee for Berkeley County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. If the Plaintiff or the Plaintiff's representative does not appear at the above-described sale, then the sale of the property will be null, void, and of no force and effect. In such event, the sale will be rescheduled for the next available sales day. Plaintiff may waive any of its rights prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property. Prospective bidders may wish to assess these matters to their satisfaction prior to sale.
