YOU ARE HEREBY SUMMONED, advised and notified that, pursuant to the South Carolina Eminent Domain Procedures Act, § 28-2-10 et seq. , the within Amended Notice of Filing Condemnation Notice, Deposit of Funds and Taking Possession of Property, a copy of which is herewith served upon you, has been filed with the Clerk of Court for Florence County. The purpose of this action is to enable the Condemnor, City of Florence, South Carolina, to acquire real property for public purposes, as are more fully stated in the Condemnation Notice and Tender of Payment attached to the Notice of Filing Condemnation Notice, Deposit of Funds, and Taking Possession of Property.
AMENDED NOTICE OF FILING CONDEMNATION NOTICE, DEPOSIT OF FUNDS, AND TAKING POSSESSION OF PROPERTY (Non-Jury)
YOU WILL PLEASE TAKE NOTICE that the Condemnor, City of Florence, South Carolina, (hereinafter referred to as “Condemnor”), has filed with the Court that Condemnation Notice and Tender of Payment dated November 19, 2025 and heretofore served the Landowner on January 7, 2026. Condemnor's Lis Pendens, along with the original Notice of Filing Condemnation Notice, Deposit of Funds, and Taking Possession of Property ("Notice of Filing"), was also transmitted to and filed with the Court on February 10, 2026.YOU ARE FURTHER NOTIFIED that Condemnor filed with the Court on February 10, 2026, Condemnor's Affidavit, attached and incorporated thereto as Exhibit A that the Landowner has rejected or refused to accept the amount tendered by the Condemnor in the above-captioned proceeding within thirty (30) days after service of the Condemnation Notice and Tender of Payment on the Landowner.YOU ARE FURTHER NOTIFIED that Condemnor has deposited the sum of TWENTY-TWO THOUSAND AND NO/100 DOLLARS ($22,000.00) with the Clerk of Court for Florence County, South Carolina, as the Condemnor's tender of payment of just compensation to the Landowner in this proceeding. The Clerk of Court shall deposit Condemnor's tender of payment in an interest-bearing account until an order from the Court directs the Clerk of Court to disburse the deposited funds.YOU ARE FURTHER NOTIFIED that the Condemnor hereby claims and intends to take immediate possession of the property, rights, privileges and easements over, under or through the subject property described in the Condemnation Notice and Tender of Payment.

PERSONALLY APPEARED before me Sarah P. Spruill who, being first duly sworn says and deposes as follows:1. That the Affiant is an attorney licensed to practice law in the state of South Carolina and is the attorney for the Condemnor, City of Florence, South Carolina (“Condemnor”), in the instant matter.2. That on January 7, 2026, the Condemnor served the Landowner a Notice of Condemnation and Tender of Payment (“Notice”), a copy of which is filed herewith and attached hereto as Exhibit 1.3. That the above named Landowner has neither accepted nor rejected in writing the Tender of Payment served by the Condemnor in the Notice and at least thirty (30) days have elapsed after service of the Tender of Payment. Therefore, the Condemnor considers the Tender of Payment as having been rejected.4. That the Condemnor demands a trial by the Court (non-jury) not earlier than sixty (60) days after the date of service of this Affidavit upon the Landowner.5. That the Condemnor does not demand that this action be given priority for trial over all other civil cases pursuant to S.C. Code Ann. § 28-2-310(C).6. NOTICE IS HEREBY GIVEN that pursuant to the South Carolina Eminent Domain Procedures Act, Section 28-2-10 et seq., of the South Carolina Code of Laws (1976), as amended, an action has been commenced and is now pending in the Court of Common Pleas for Florence County, South Carolina, upon the Condemnation Notice and Tender of Payment by the above-named Condemnor against the above-named Landowner for the acquisition of that approximately 0.19-acre parcel on the northern side of East Darlington Street, as is described on the attached Exhibit A, and further identified as that parcel bearing Florence County Tax Parcel Number 90086-06-026 (hereinafter referred to as the “Property”), in the County of Florence, State of South Carolina. Upon information and belief, Landowner has or claims an interest in the property by virtue of a deed from Robert's Rentals LP dated September 26, 2012 and recorded on September 27, 2012 in the records of the Register of Deeds for Florence County in Deed Book B427 at Pages 107-110.TOGETHER WITH all and singular the rights, members, hereditaments, and appurtenances thereunto belonging or in anywise incident or appertaining. The property, rights, privileges and easements acquired herein shall exist in perpetuity and shall inure to the benefit of the Condemnor, its successors and assigns.
