This case involves a petition for declaratory judgment concerning the real property located at 219 Ike Street, San Antonio, Texas and is described as Lot 30, Block 10, New City Block 11226, San Antonio, Bearer County, Texas. Plaintiff seeks a judicial determination that the obligations owed to Rudolfo Durand by Plaintiff under a Contract for Deed between them has been fully satisfied and the contract has been fully performed by Plaintiff; that the purchase money lien on the property created by the Contract for Deed is released and of no effect; and that enforcement of the Contract for Deed is barred by the 4-year statute of limitations and the purchase money lien is void.
