PUBLIC NOTICECASE NO. 01-CV-2025-905483.00MOMENTUM TELECOM, INC.vsRURAL TEXAS BROADBAND, INC.NOTICE OF SERVICE BY PUBLICATIONCIRCUIT COURT OF JEFFERSON COUNTY, ALABAMA TO: THE DEFENDANT, RURAL TEXAS BROADBAND, INC. TAKE NOTICE that a Complaint seeking relief against you has been filed in the above-entitled action by the plaintiff Momentum Telecom, Inc. (Plaintiff). Plaintiff alleges (1) breach of a telecommunications equipment agreement by Rural Texas Broadband, Inc. (the Defendant), (2) open account based on the telecommunications equipment agreement breached by the Defendant, and (3) unjust enrichment / quantum meruit by the Defendant for knowingly accepting and retaining the benefits received from the telecommunications equipment agreement with Plaintiff without compensating Plaintiff for those benefits. Plaintiff is requesting relief in the amount of the entire indebtedness outstanding and due under the telecommunications equipment agreement, including principal, all accrued and accruing interest, attorneys fees and costs, and all other charges, expenses, amounts and fees due and owing thereunder, plus post-judgment interest. Pursuant to the Courts Order Granting Motion for Service by Publication dated April 7, 2026, authorizing service upon the Defendants to be made via publication pursuant to Rule 4.3 of the Alabama Rules of Civil Procedure, Defendant is hereby commanded and required to file with the Clerk of the Court and to serve upon Plaintiffs counsel, Nolan S. Clark, Bradley Arant Boult Cummings LLP, 1819 5th Avenue North, Birmingham, AL 35203, an answer to the Verified Complaint within thirty (30) days of May 13, 2026, which is the last date of publication of this notice; if Defendant does not file an answer on or before June 12, 2026 (which is 30 days after the last publication of this notice), a default judgment may be entered against the Defendant for the relief requested in the Complaint.
