NOTICE OF SALE
NOTICE IS HEREBY GIVEN that the undersigned Special Master will on the 1st day of May, 2026, at the hour of 1:00 P.M., at the front entrance of the Otero County Courthouse, 1000 New York Avenue, Alamogordo, New Mexico 88310, sell and convey to the highest bidder for cash or certified funds all the rights, titles and interests of the parties hereto in and to the following described real estate in said county and state ("Real Property"):
a.Lot 6 Block 148 Unit T-9 in Timberon Subdivision, Otero County New Mexico, as shown by Plat thereof filed in the office of the County Clerk and Ex-officio Recorder of Otero County, New Mexico Sept. 17, 1981,
with a common address of 66 Itasca Timberon, New Mexico;
b.Timberon Unit 3 Block 54, Lot 25 Timberon Subdivision, Otero County, New Mexico as shown by Plat thereof filed in the office of the County Clerk and Ex-Officio Recorder of Otero County, New Mexico,

with a common address of 206 Hoover Drive, Timberon, New Mexico;
j.Lot 6A, Block 3 (1.220 Acres) Commercial Area, Unit 1

with a common address of 1579 Sacramento Dr., Timberon NM 88350, assigned Otero County Assessor Parcel #R042025.
Lot 6A is shown and described in that certain Timberon Commercial Addition, Unit - 1 Block 3 Replat A, Lot 5, Lot 6, Lot 7
recorded in the records of the Otero County, New Mexico Clerk and
Recorder as Instrument #202501237 on February 11, 2025. Said Replat
effected and records a replat and combination of Lots 5, 6, and 7 of
of Timberon Commercial Addition, Unit - 1, Block 3.
If there is a conflict between a common address and legal description, the legal description shall control.
Said sale of the Real Property will be made by individual parcel or tract, not en masse, to satisfy the in rem judgment of foreclosure and judgment liens in the total amount of $110,473.99 pursuant to the Default Judgment of Foreclosure entered on March 12, 2026, in the above-styled and numbered cause of action which was a suit for declaratory judgment and to foreclose judgment liens on the above-described properties.
Plaintiff, the judgment lien holder, shall have the right to bid all or any portion of his Judgment or Judgment 2 in lieu of cash. Plaintiff may submit his bids in writing, delivered to the Special Master in advance of sale, or by bid at the sale of the Special Master. In accordance with the Court's decree, the proceeds of said sale will be applied: FIRST: To the costs and expenses of sale, including but not limited to the fee of the Special Master and costs of publication; SECOND: To interest accrued on the Plaintiff's Judgment and/or Judgment 2 secured by the Real Property from the date of entry of this judgment through the date of the sale; and, THIRD: To the Plaintiff's Judgment and/or Judgment 2. The balance, if any, shall be deposited into the Court Registry and applied as may be determined by the Court.
NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein and all recorded and unrecorded special assessments and taxes that may be due.
NOTICE IS FURTHER GIVEN that this sale may be subject to a bankruptcy filing, a payoff, a reinstatement or any other condition that would cause the cancellation of this sale. Further, if any of these conditions exist at the time of sale, this sale will be null and void, the successful bidder's funds shall be returned and the Special Master and the Mortgagee giving this notice shall not be liable to the successful bidder for any damages.
NOTICE IS FURTHER GIVEN that a condition of sale is that the winning bidder, if other than Plaintiff, shall tender cash or certified funds to the Special Master for the bid amount by 5:00 P.M. on the date of the sale.
NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above-described real property subject to a period of redemption of nine (9) months and entry of an order of the Court confirming and approving the terms and conditions of sale.
