NOTICE OF ADOPTION OF ORDER ESTABLISHING RATES AND CHARGES AND ADOPTINGRULES AND POLICIESREGARDING THEDISTRICT'S SYSTEMSThe Board of Directors of Sinton Ranch Municipal Utility District (the “District”) has adopted an Order Establishing Rates and Charges, and Adopting Rules and Policies Regarding the District's Utility Systems (the “Rate Order”), which establishes procedures to: regulate commencement of construction in the area of or connection to the District's facilities or receipt of District services; incorporate facilities into the District's facilities; limit discharges into the District's water, wastewater and drainage systems; implement a customer service agreement and regulations for private lift stations; secure and maintain safe, sanitary and adequate plumbing facilities as part of its sewer system; regulate privileges on any land or easement controlled by the District; adopt rates, charges, and security deposits for the District's services; prohibit tampering with or damage to, and protect the District's systems; and meter, bill for, and terminate service. Violations of the rules contained in the Rate Order will result in the violator being subject to a penalty in an amount per violation that does not exceed the jurisdiction of justice court, as provided by Section 27.031 of the Texas Government Code. The offending party will also be liable for any costs incurred by the District in connection with any repairs or corrections necessitated by the violation. Specific penalties include a penalty of $5,000 for each violation, with each day that the violation continues constituting a separate offense, plus any attorneys' fees and court costs, for violating rules related to unauthorized installation or operation of private lift stations, unauthorized use of water, prohibited discharges of sewage, or prohibited deposits of debris, yard waste, garbage or other unsanitary materials upon property located within the boundaries of the District. Pursuant to Sections 49.004 and 54.206 of the Texas Water Code, the Order may be enforced by complaints filed in the appropriate court of jurisdiction in San Patricio County, Texas and will be recognized by the courts as if they were penal ordinances of a city. The Rate Order is on file in the principal office of the District at the offices of Armbrust & Brown, PLLC, 100 Congress Avenue, Suite 1300, Austin, Texas 78701, where it may be read by any interested person.
