	204021ORDINANCE NO. 117AN ORDINANCE OF NEZ PERCE COUNTY AMENDING AND ENACTING IN TITLE 110, (ARTICLE III, SECTION 110.12.370), (ARTICLE IV, SECTION 110.12.540 AND SECTION 110.12.550), (ARTICLE V, SECTION 110.12.710 AND SECTION 110.12.720), (ARTICLE X, SECTION 110.12.1460), AND (ARTICLE IX, SECTION 110.12.1300) OF THE NEZ PERCE COUNTY LAND DEVELOPMENT CODE, AND FURTHER PROVIDING FOR AN EFFECTIVE DATE.BE IT ORDAINED BY THE BOARD OF COUNTYCOMMISSIONERS OF NEZ PERCE COUNTY, IDAHO:Section 1. Nez Perce County Code Title 110, Article III, Section 110.12.370, is hereby amended as follows:Sec. 110.12.370. Permitted uses.&tab;(8) &tempmargin;Farming, including grazing.(, except a CAFO shall not be permitted)&tab;a. &tempmargin;Confined Animal Feeding Operations (CAFOs) subject to Chapter 110.28 – CAFOs, shall not be permitted.Section 2. Nez Perce County Code Title 110, Article IV, Section 110.12.540, is hereby amended as follows:Sec. 110.12.540. Permitted uses.&tab;(6) &tempmargin;Farming, including grazing, provided that the keeping of animals shall be subject to section 110.16.120 – Animals in the RR, R-1, PRD, and PUD districts.&tab;(7) &tempmargin;Alternative farm enterprises for the sale of agricultural products produced on the premises, except livestock, provided there is sufficient area to allow automobiles to park safely off the road right-of-way and to re-enter the traffic in a forward direction; subject to section 110.16.150 – Wineries and breweries.Section 3. Nez Perce County Code Title 110, Article IV, Section 110.12.550, is hereby amended as follows:Sec. 110.12.550. Conditional uses.&tab;(5) &tempmargin;Alterative farm enterprises for the sale of agricultural products produced on the premises, except livestock, provided there is sufficient area to allow automobiles to park safely off the road right-of-way and to re-enter the traffic in a forward direction; subject to section 110.16.150 – Wineries and breweries.&tab;(6) 5) Public and semi-public uses.Section 4.
