NOTICE OF PROPOSED ADOPTION OF ORDINANCE NO. 1273 OF THE CITY COUNCIL OF THE CITY OF BREA, REVISING PENALTIES AND REMEDIES FOR VIOLATIONS OF THE BREA CITY CODE AND AMENDING TITLE 1 “GENERAL PROVISIONS” OF THE BREA CITY CODE PLEASE TAKE NOTICE that on May 05, 2026, at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Council Chambers, Brea Civic Cultural Center, 1 Civic Center Circle, Brea, California, the City Council of the City of Brea will consider adopting its Ordinance No. 1273 entitled “ An Ordinance of the City Council of the City of Brea Revising Penalties and Remedies for Violations of the Brea City Code .” A summary of this Ordinance follows: Summary of Ordinance No. 1273 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BREA REVISING PENALTIES AND REMEDIES FOR VIOLATIONS OF THE BREA CITY CODE, AND AMENDING TITLE 1 “GENERAL PROVISIONS” OF THE BREA CITY CODEThe City Council has determined that, to more fully protect public health, safety, and welfare, it is necessary to update the existing administrative penalties for code violations related to short-term rentals and building and safety. The goal of these changes is to provide a more effective mechanism for promoting compliance and deterring repeat violations. In addition, the proposed updates would provide staff with stronger enforcement tools based on the severity and frequency of violations. The Ordinance updates fines associated with building and safety code infractions: from $100 for a first violation to $130; from $200 to $700 for a second violation; and from $500 to $1,300 for any additional violations within one year. Furthermore, commercial properties are subject to a $2,500 fine for each additional violation of the same ordinance within 2 years. The Ordinance also outlines specific administrative penalties for violations of Chapter 5.32 of the Brea City Code regarding short-term rentals, with their own fines. The maximum fines for short-term rental violations are $1,500 for a first violation, $3,000 for a second violation of the same ordinance within one year of the first, and $5,000 for each additional violation of the same ordinance within one year of the first.
