NOTICE IS HEREBY GIVEN that on May 27, 2026, at 6:00 p.m., or as soon thereafter as the case may be heard, the City Council of the City of Irwindale will conduct a public hearing in the City Council Chambers located at 5050 North Irwindale Avenue, Irwindale, California 91706, to consider the following:
AN INTERIM URGENCY ORDINANCE (ORDINANCE NO. 819) PROHIBITING THE PROCESSING OF, AND THE ACCEPTANCE OF, NEW DATA CENTER LAND USE APPLICATIONS WITHIN THE CITY OF IRWINDALE IN ORDER TO CONSIDER ADOPTING ADDITIONAL REGULATIONS FOR SUCH LAND USES NECESSARY FOR THE HEALTH, SAFETY, AND WELFARE OF THE PUBLIC

Government Code Sections 36934, 36937 and 65858 expressly authorize the City Council to impose a moratorium for the immediate preservation of the public peace, health or safety and to prohibit a use that is in conflict with a contemplated general plan, specific plan, or zoning proposal that the legislative body, planning commission or the planning department is considering or studying or intends to study within a reasonable time. At present, the Zoning Code does not expressly identify or regulate data processing centers, data centers, server farms, or similar facilities characterized by the operation of computer servers, network infrastructure, digital storage systems, and related equipment used for the processing, storage, transmission, and management of electronic data. As such, the City has determined that such uses are not adequately contemplated within the existing zoning framework. The proposed interim urgency measure for the processing and approval of applications for data centers, new construction of data centers, and the replacement or conversion of existing facilities into data centers in order to mitigate or avoid the potential adverse impacts of such uses would allow City staff an opportunity to study the potential impacts before they occur and to develop regulations to the zoning code which will allow City’s goals and objectives to be met.
The City has determined that this action is exempt from the provisions of the California Environmental Quality Act because this proposed ordinance is not a project within the meaning of Sections 15060(c)(3) and 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, either directly or indirectly. Alternatively, this ordinance is also exempt pursuant to Section 15061(b)(3) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, since the proposed ordinance involves a temporary moratorium on the processing of applications or approvals for any data centers and it is clear that there is no possibility that the ordinance may have a significant impact on the environment.
All interested persons will be given the opportunity to speak at the public hearing. If you challenge the adoption of the ordinance in court, you may be limited to raising only those issues raised at the public hearing described in this notice, or in correspondence delivered to the City Council at, or prior to, the public hearing.
