NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS April 22, 2026 Contra Costa County Department of Conservation and Development 30 Muir Road Martinez, CA 94553 This notice shall satisfy two separate but related procedural requirements for activities to be undertaken by Contra Costa County. REQUEST FOR RELEASE OF FUNDS On or about May 8, 2026, Contra Costa County (County) will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Section 8 Project-Based Voucher funds under U.S. Code Title 42, Chapter 8 of the United States Housing Act of 1937 (42 U.S.C. Section 1437f), as amended, to undertake a project known as the Harbor Pointe Project (proposed project) in the unincorporated community of Discovery Bay, Contra Costa County. USA Property Funds proposes to develop the Harbor Pointe Affordable Housing Project at 1700 Discovery Bay Boulevard, at the northwest corner of the intersection between Discovery Bay Boulevard and Sand Point Road, in the Discovery Bay area of unincorporated Contra Costa County, California. The property is identified by Assessor's Parcel Number 004-182-008-5. The proposed project would include the construction of a 170-unit affordable housing complex consisting of seven three-story apartment buildings, one clubhouse, and one maintenance building. Each building would contain 24 units, totaling 168 units, with two additional manager's units located above the proposed clubhouse. The apartment complex would consist of 42 one-bedroom units ranging from 558 square feet (sf) to 615 sf, 85 two-bedroom units ranging from 740 sf to 846 sf, and 43 three-bedroom units ranging from 980 sf to 1,057 sf. The proposed project would target lower-income households earning between 30 percent and 70 percent of the Area Median Income (AMI) for Contra Costa County. The proposed project would include an 8,118-sf clubhouse containing a clubroom, fitness room, electrical room, two restrooms, storage room, leasing office, manager's office, and a laundry room. Attached to the clubhouse would be an outdoor amenity plaza, including a shade structure, lounge seating, picnic area, picnic tables, two barbeques, tot lot, game area with ping pong, foosball, and cornhole facilities, and outdoor fitness station. A 426-sf maintenance building and fenced dog park with dog waste station would be located on the northern boundary of the project site. Primary site access would be provided by a new driveway at the eastern boundary of the project site, off of Discovery Bay Boulevard. An additional new driveway would be provided at the southwestern corner to the project site off of Sand Point Road. A total of 305 parking spaces would be provided throughout the site, including 12 spaces designed in compliance with the Americans with Disabilities Act (ADA). In addition, the proposed project would include four pedestrian access gates with associated pathways and connections to the internal sidewalks. The 6.03-acre project site currently consists of undeveloped vacant land with trees concentrated around the periphery of the site. Surrounding existing land uses include the Discovery Bay Shopping Center to the north; the Discovery Bay Community Center and undeveloped land to the east, across Discovery Bay Boulevard; single-family residences to the south, across Sand Point Road; and single-family residences to the west. The Conta Costa County General Plan designates the project site as Housing Element Consistency Zone/Mixed Use Community Specific, and the site is zoned Housing Element Consistency District Urban Farm Animal Exclusion (HE-C-UE). The total development cost is projected to be $86,000,464; $2,945,480 of which would be funded through Section 8 Project-Based Vouchers, administered through HUD over a 20-year commitment. FINDING OF NO SIGNIFICANT IMPACT The County of Contra Costa has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. The Environmental Assessment (EA) and additional project information contained in the Environmental Review Record (ERR), is available at the County of Contra Costa Department of Conservation and Development (DCD) offices located at 30 Muir Road, Martinez, CA, and may be examined or copied on weekdays by appointment between the hours of 8:00 AM and 5:00 PM. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the County of Contra Costa Department of Conservation and Development to the attention of Susan Johnson at Susan.Johnson@dcd.cccounty.us or via U.S. mail at 30 Muir Road, Martinez, CA 94553. All comments received by 5:00 PM on Thursday, May 7, 2026, will be considered by Contra Costa County prior to authorizing submission of a request for release of funds. The physical copy of the ERR is on file at the DCD offices located at 30 Muir Road, Martinez, CA, and may be examined or copied on weekdays by appointment between the hours of 8:00 AM and 5:00 PM. ENVIRONMENTAL CERTIFICATION The County of Contra Costa certifies to the U.S. HUD that Gabriel Lemus, Deputy Director, in his capacity as NEPA Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the use of Project-Based Voucher Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to the County's Request of Release of Funds and Environmental Certification for a period of 15 days following the submission date specified above or the actual receipt of the request (whichever is later) only if they are on the following bases: (a) the certification was not executed by the Certifying Officer of The County of Contra Costa (b) the County of Contra Costa has omitted a step or failed to make a determination or finding required by HUD regulations at 24 CFR Part 58 or (c) the grant recipient or other participants in the development process has committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; (d) another Federal acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections to the release of Section 8 Project-Based Vouchers must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the San Francisco HUD Regional Office at One Sansome Street, Suite 1200, San Francisco, CA 94104, or via email at Alison.M.Brokke@hud.gov.
