LEGAL NOTICEPLANNING COMMISSION PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Oceanside, California, will on Monday, May 18, 2026, at 6:00 p.m. in the Council Chambers of City Hall Civic Center, 300 North Coast Highway, Oceanside, California, conduct a public hearing to consider the following ordinance. For information on attending or providing comments, please visit the City’s Website at https://records.ci.oceanside.ca.us/gov/dev/planning/agendas.asp 1. Consideration of a recommendation to the City Council regarding a phased implementation and exemption ordinance consistent with Senate Bill 79 (Gov. Code Sections 65912.160 and 65912.161(b)). – SB 79 PHASED IMPLEMENTATION ORDINANCE – PLANNING PROJECT – CITY OF OCEANSIDE Environmental Determination: Per the California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(5), an ordinance implementing Senate Bill 79 does “not” meet the definition of a “Project,” defined as the action with a potential to result in either a direct or indirect physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. CEQA Guidelines section 15060(c)(3) further states an activity is not subject to further environmental review if not determined to be a “project.” If the activity was determined to be “project” under CEQA Guidelines, the proposed project will be Exempt from California Environmental Quality Act (CEQA) per Guidelines Section, 15061(b)(3), the Common Sense Exemption. The proposed text amendment does not have the potential to cause a significant effect on the environment and is therefore exempt from CEQA review. If you should wish to challenge this project in court, at some future time, you may be limited to raising only those issues you or someone else raised at the public hearing described in the notice or in written correspondence delivered to the Planning Commission at or prior to the public hearing.
