COUNTY OF RICHMOND )
     WHEREAS, Jose Tomes (the "Borrower"), caused a Promissory Note dated February 28, 2020 to be executed and delivered to Upper Landing, LLC, 901 Greene Street, Augusta, Georgia 30901, evidencing the Borrower's indebtedness in the original principal amount of Fifty Five Thousand and 00/100 Dollars ($55,000.00), together with interest thereon (the "Note"); and
     WHEREAS, the Borrower executed and delivered to Upper Landing, LLC that certain Deed to Secure Debt and Security Agreement (the "Security Deed") dated February 28, 2020, recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Book 1716, Pages 2379 et seq., conveying the following described real property as security for the payment of the debt evidenced by the Note; and
     WHEREAS, Upper Landing, LLC is the holder of the Note more fully described in the Security Deed;
     WHEREAS, the indebtedness evidenced by the Note is secured by property described as (the "Property"):
All that tract and parcel of land, together with any improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, containing 9.3 acres and being shown and designated upon a plat prepared by Ayer, Graham & Associates, Inc., dated November 29, 1982, which is filed for record in the Office of the Clerk of the Superior Court, Richmond County, Georgia in Realty Reel 157, Page 1468.  Reference is hereby made to said plat for a more complete and accurate description of the metes, bounds and location of the property.
This being the same property conveyed to Grantor herein by Deed dated November 30, 1982 and filed for record in the aforesaid Clerk's Office in Realty Reel 157, Page 1467.

The Property is known under the present street numbering system as 4760 L Old Waynesboro Road, Augusta, Georgia  30906.
     WHEREAS, the Borrower defaulted in the payment of the indebtedness by refusing to pay the indebtedness according to the terms of the Note, authorizing Upper Landing, LLC to exercise its power of sale in the Security Deed;
     NOW, THEREFORE, pursuant to and in exercise of the power of sale contained in the Security Deed and for the purpose of collecting the indebtedness secured thereby (including attorney's fees and expenses of sale), Upper Landing, LLC will offer the Property for sale to the highest bidder, for CASH, at public outcry, before the Courthouse door in Richmond County, Georgia on the First Tuesday in May, to wit:  May 5, 2026, between the legal hours of sale.
     Upper Landing, LLC will convey title to the Property as attorney-in-fact for the Borrower, all as provided for in the power of sale and authority granted in the Security Deed.  The money derived from the sale will be applied as follows: (i) first to expenses of the sale, including reasonable attorney fees; (ii) second to the amount due on the Note secured by the Property described in the Security Deed; and (iii) the balance, if any shall be paid as provided by law.
     The Property will be sold for CASH subject to any unpaid ad valorem taxes (including taxes which are a lien but not yet due and payable), any matters which might be disclosed by an accurate survey or inspection of the Property, encumbrances, zoning ordinances, restrictions, covenants and matters of record, if any, superior to the Security Deed, street improvements and easements and restrictions of record.  Purchaser is to pay cost of recording the deed.
     To the best knowledge and belief of the undersigned, the party in possession of the Property is the Borrower.  The Property is commonly known as 4760 L Old Waynesboro Road, Augusta, Georgia 30909.
