NOTICE OF FORFEITURE

TO: Judy Daniel, and Persons in Possession of 5811 SE 35th Cir., Des Moines, IA 50320.
You and each of you are hereby notified:
(1) The written contract dated August 19, 2016 and executed by Jeremy McFarland, as Manager/Member, on behalf of HMC Properties, LLC as Vendor/Seller, and Judy Daniel as Vendee/Buyer, recorded on May 19, 2022 in the office of the Polk County Recorder, recorded as document reference number Book 19118, Page 737 as amended by the Real Estate Contract Extension dated October 6, 2023 and executed by Jeremy McFarland, as Manager/Member, on behalf of HMC Properties, LLC as Vendor/Seller, and Holly Drips and Robert Dripps as Vendee/Buyer, recorded on October 17, 2023 in the office of the Polk County Recorder, recorded as document reference number Book 19629, Pages 925-928 for the sale of the following described real estate:
LOT 1 STERLING TRACE PLAT 1
Locally known as: 5811 SE 35th Cir., Des Moines, IA 50320
has not been complied with in the following particulars:
a) Remainder of Balloon Payment $ 174,691.65 due
b) Real Estate Taxes $2,770.00
Total: $ 177,461.65
As shown above, Buyer is behind in payments in the amount of $177,461.65.
(2) The contract shall stand forfeited unless the parties in default, within 30 days after the completed service of this notice, shall perform the terms and conditions in default, and in addition pay the reasonable costs of serving this notice.
(3) The amount of attorney fees claimed by the Vendors pursuant to Section 656.7 of the Code of Iowa is $ 50.00 (not to exceed $50.00). Payment of the attorney fees is not required to comply with this notice in order to prevent forfeiture.
