NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION REQUEST TO RELEASE CONSERVATION EASEMENT -PUBLIC NOTICE OF HEARING - TAKE NOTICE that, in accordance with the New Jersey Conservation Restriction and Historic Preservation Restriction Act, N.J.S.A. 13:8B-5, the New Jersey Department of Environmental Protection, Division of Watershed and Land Management (the "Department") has received an application for a partial release of the current Conservation Easements/Declarations of Environmental Restrictions by and between New York Susquehanna & Western Railway Corp. and the New Jersey Department of Environmental Protection dated December 12, 2012, on property identified as Block 485; Lot 1.09. The lot is shown on the official tax map of the Township of North Bergen in Hudson County, New Jersey. The wetland mitigation site will be directly affected by an access road necessary for emergency access and safe construction of a viaduct founded on piers as part of the Hudson Tunnel project. The Department originally approved the Hudson Tunnel project on March 31, 2016, under File #0809-02-0003.6. The access road was not included in that approval. Therefore, a second approval is required and pending under File #0900-08-0003.3 specifically for the access road. As compensation for the partial release of the conservation restriction described above mitigation and replacement resources will be provided that at a minimum will result in an equivalent or increased level of protection for the regulated resource, that does not compromise in any way the value of the original protected resource.
