The basis of venue is the location of the subject property, which is New York County, New York. TO THE ABOVE-NAMED DEFENDANTS: The foregoing summons is served upon you by publication, pursuant to an Order of Francis A. Kahn, III, a Justice of the Supreme court, dated April 16, 2026, and filed with the supporting papers in the New York County Clerk’s Office. This is an action to foreclose on the property known as 2647-2649 Broadway, New York, New York 10025, legal description: Block 1872 and Lot 52 of the New York County Tax Assessment Map in the Borough of Manhattan, State of New York. The relief sought is the finding that Plaintiff has a first and best lien on the property; an Order finding that Plaintiff has the legal right and is authorized to foreclose on the Property; an Order finding the such foreclosure will vest in the purchaser thereat free and clear title to the Property, free of any and all interests that are or might be asserted by the Defendants; an Order that Plaintiff has the right to credit bid at such foreclosure sale any and all amounts due to Plaintiff under the Loan Documents; an Order directing that the Sheriff of New York County, New York, or any referee appointed in this action, foreclose the Property and deliver the title to the successful bidder at such foreclosure; an Order directing how to apply the proceeds of the sale; an Order that Borrower has no right of redemption or reinstatement with respect to the Property; and an Order finding that Plaintiff has preserved its right to pursue any deficiency that may exist.
