RESOLUTION NO. 55-26 1/29/26 COA LL FIX HRG. Establish Surchg. Playhouse Theater

RESOLUTION TO FIX HEARING DATE FOR LOCAL LAW TO ESTABLISH SURCHARGE FOR TICKET SALES FOR ADMISSION TO EMERSON PARK PLAYHOUSE THEATER

WHEREAS, Cayuga County (the “County”) is the owner of certain land and improvements more commonly referred to as “Emerson Park” (the “Park”) and located at the north end of Owasco Lake in the County of Cayuga; and,

WHEREAS, located within the Park is a building, improved as a theater which was formerly a merry-go-round and is now commonly referred to as the “Merry-Go-Round Playhouse,” (herein, “Playhouse”); and

WHEREAS, the County has heretofore leased the Playhouse and related storage facilities to a theater production company for the purpose of presenting family entertainment in the form of musical productions, dramatic plays, and youth-based theater productions; and

WHEREAS, the Cayuga County Legislature finds that the Playhouse has proven to be an income generating facility and therefore it behooves the County to utilize the Playhouse in a manner that will generate revenue for the County to offset the cost of maintaining the building and related facilities;

WHEREAS, the Cayuga County Legislature further finds that it is in the public interest to establish a surcharge for the sale of tickets for admission to the Playhouse in lieu of charging rent to the theater company for use of the Playhouse; and

WHEREAS, there has been duly presented and introduced at a regular meeting of this County Legislature held on December 11, 2025, a proposed local law entitled:

A LOCAL LAW TO ESTABLISH A SURCHARGE FOR TICKET SALES FOR ADMISSION TO EMERSON PARK PLAYHOUSE THEATER; now, therefore be it

RESOLVED, that a public hearing shall be held concerning the proposed local law before the Cayuga County Legislature on Tuesday, February 24, 2026, at 6:00 P.M., at the Ward O’Hara Museum, 6880 East Lake Road Rt. 38A Auburn, New York 13021 (Across from Emerson Park),, and also held electronically and broadcast live via YouTube at the following address: https://www.youtube.com/live/rHaosBz3kOI, with members of the public directed to call in at 315-294-8051 to comment, to hear all interested parties on said proposed Local Law;

RESOLVED, that the Clerk of the Cayuga County Legislature is hereby directed to give due legal notice of said public hearing as provided by statute.
