LEGAL NOTICE NEW YORK STATE URBAN DEVELOPMENT CORPORATION D/B/A EMPIRE STATE DEVELOPMENT AND ERIE CANAL HARBOR DEVELOPMENT CORPORATION NOTICE OF PUBLIC HEARING TO BE HELD Wednesday, February 25, 2026, PURSUANT TO SECTION 16 OF THE NEW YORK STATE URBAN DEVELOPMENT CORPORATION ACT IN CONNECTION WITH THE PROPOSED BUFFALO OUTER HARBOR CIVIC AND LAND USE IMPROVEMENT PROJECT PLEASE TAKE NOTICE that the Erie Canal Harbor Development Corporation (“ECHDC” or the “Corporation”), a subsidiary of the New York State Urban Development Corporation, doing business as Empire State Development (“ESD”), pursuant to Section 16(2) of the New York State Urban Development Corporation Act (Chapter 174, Section 1, Laws of 1968, as amended) (the “Act), has adopted a Modified General Project Plan (the “Plan”) with respect to the Buffalo Outer Harbor Civic and Land Use Improvement Project (the “Project”) on February 9, 2026. Copies of the Plan are available without charge to any person who shall make a request for the same at the office of the Corporation. The Corporation will file such Plan in the offices of the Erie County Clerk at 92 Franklin Street, Buffalo, NY 14202. A copy of the Plan is available for inspection online at: https://esd.ny.gov/erie-canal-harbor-development-corporation-projects or by request. Send email requests to: eriecanalharbor@esd.ny.gov Subject: Plan- Buffalo Outer Harbor Civic and Land Use Improvement Project. The Plan was originally adopted and affirmed in 2021. It is being modified to provide further description to the anticipated functions and utilization of the water and land areas located in the vicinity of Slip 2, a navigable basin on the Buffalo Outer Harbor. The Slip itself is within a subarea under the 2021 Plan known as the “Michigan Pier”, while the land area immediately south of the Slip is within a subarea known as “The Meadows”. Under the Michigan Pier subarea, specifically anticipated water uses in Slip 2, the term “commercial watercraft” is being further specified as including ferries, cruise boats, etc. Under The Meadows subarea description, the function of the public and support facilities is being further supplemented by identifying passenger processing facilities (e.g., customs), as well as other types of support facilities for cruise ship access/operations. PLEASE TAKE FURTHER NOTICE, that, in accordance with Section 16(2) of the Act, a public hearing, open to all persons, will be held by the Corporation on the 5th Floor of 95 Perry Street, Buffalo, NY 14203 on February 25, 2026, from 9:00 a.m. to 10:00 a.m. to comment on the Plan Modifications. At the hearing, members of the public and other interested parties will be afforded an opportunity to appear and comment and/or submit written statements on the Plan. These comments will be transcribed at this meeting for the public record. Copies of the Plan also will be available at the hearing location.
