LEGAL NOTICE NOTICE PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Town of East Greenbush will hold a public hearing on April 28, 2026 at the Town Hall 225 Columbia Turnpike Rensselaer NY beginning at 7:30 P.M. to consider the follow- ing application: Appeal number # 2026- 03: The appeal of Green- bush Realty Partners, LLC of 509 State Route 67, Malta, NY 12020. The applicant proposes the construction of a two-tenant restaurant building without a hab- itable second story in the Town Center Dis- trict. The proposal does not comply with the following provisions of the Town's Comprehen- sive Zoning Law: Sec- tion 2.7.1(F) Specific District Standards; spe- cifically, the Two story height requirement, - which states, "New con- struction must have a minimum of two story facade height for any portions of the build- ings which have front- age along a public road. Such second story frontage must contain habitable space at least 20 feet deep measured from the front of the building to the back. Other portions which compose the rear of the building, structures fur- ther than 50 feet from the public road or that are otherwise not di- rectly visible from the public way are exempt. The intent of this provi- sion is to create a stron- ger and more tradi- tional public street wall within the TC districts." Therefore, the proposed action requires one area variance for the property located at 613 Columbia Turnpike, East Greenbush, NY 12061, Tax Map # 167.15-7-6.2. Any interested parties may comment in person at the hearing. Written comments may also be submitted to the Zoning Board of Appeals, Town of East Greenbush, 225 Columbia Turnpike, Rensselaer, NY 12144, at any time prior to the hearing.
