CONSOLIDATED ZONING BOARD OF APPEALS
NOTICE OF PUBLIC HEARING
195 MAIN STREET, VILLAGE OF HIGHLAND FALLS, NEW YORK
PUBLIC NOTICE is hereby given that the Town of Highlands Consolidated Zoning Board of Appeals will conduct a public hearing on the application of ESR Development, Incorporated, pertaining to property located at 195 Main Street in the Village of Highland Falls, New York, for the purpose of constructing a five-story mixed-use building with retail and parking on first floor and 48 one- and two- bedroom apartments on the upper floors. The property is identified on the Town of Highlands' tax map as Section 105, Block 3, Lot 20 and is located in the Business-1 and Residential-5 zoning districts. The Applicant is requesting that the B-1 district be extended to the entirety of the lot pursuant to § 240-7F of the Village of Highland Falls Zoning Law. The Applicant is also requesting five (5) variances from the following sections of the zoning law: (1) an increase in height from the maximum permitted 50 feet to 57 feet, (2) § 240-37B reduction of the minimum residential floor area per dwelling unit from 750 square feet to 580 square feet, (3) reducing the ground floor area dedicated to commercial use from no less than 50% to 15% (the Building Inspector determined that the commercial area was 14.2%), (4) reducing off- street loading from the required 2 parking spaces to 1 parking space, and (5) § 240-42, a variance from the required 88 (the Building Inspector determined that 97 parking spaces were required) parking spaces to 41.
A copy of the application is available for inspection at the Town's Building Department, located at 254 Main Street in Highland Falls, New York, and is also available on the Town of Highlands website.
NOW, THEREFORE, the Town of Highlands Consolidated Zoning Board of Appeals declares that it will hold an in-person public hearing on the aforesaid application at the Town of Highlands Town Hall, 254 Main Street in Highland Falls, New York, on Wednesday, May 20, 2026, at 7:00 P.M., at which time all persons interested therein shall be heard. The Board will also accept written comments prior to the date of the public hearing.
