Summary of Ordinance No. CS-514 per Government Code §36933(c) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING PROVISIONS OF CHAPTER 11.16 CLARIFYING THE REGULATION OF THE TEMPORARY STORAGE AND STAGING OF CONSTRUCTION EQUIPMENT AND MATERIALS WITHIN THE CITY’S PUBLIC RIGHT-OF-WAY OR ON PUBLIC PROPERTY Chapter 11.16 of the Carlsbad Municipal Code establishes the requirements and steps to allow for work or encroachments within the public right-of-way. The proposed ordinance amends Chapter 11.16 to clarify the regulation of the temporary storage and staging of construction equipment and materials within the city’s public right-of-way or on public property. As amended, Chapter 11.16 will allow for temporary construction support uses within the public right-of-way and on public property following the issuance of a right-of-way permit, subject to the following standards: Only developed or disturbed public property may be used.
