Summary of Ordinance No. CS514 per Government Code �36933(c) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING PROVISIONS OF CHAPTER 11.16 CLARIFYING THE REGULATION OF THE TEMPORARY STORAGE AND STAGING OF CONSTRUCTION EQUIPMENT AND MATERIALS WITHIN THE CITY'S PUBLIC RIGHTOFWAY OR ON PUBLIC PROPERTY Chapter 11.16 of the Carlsbad Municipal Code establishes the requirements and steps to allow for work or encroachments within the public rightofway. The proposed ordinance amends Chapter 11.16 to clarify the regulation of the temporary storage and staging of construction equipment and materials within the city's public rightofway or on public property. As amended, Chapter 11.16 will allow for temporary construction support uses within the public rightofway and on public property following the issuance of a rightofway permit, subject to the following standards: Only developed or disturbed public property may be used. Public property (a particular site or stretch of public road) may be used for cityinitiated construction projects no more than three times per year, with each use not to exceed 60 consecutive calendar days unless authorized by the City Engineer.Temporary perimeter screening and security fencing shall be installed. Use must comply with city construction operating hours and stormwater standards. The tools, materials, equipment and construction assembly operations shall be removed, and the site restored and/or repaired to the satisfaction of the City Engineer before final approval of the construction project.
