CITY OF MISSION VIEJOCITY COUNCILNOTICE OF PUBLIC HEARING Notice is hereby given that the City Council of the City of Mission Viejo will conduct a public hearing pertaining to the item listed below. DATE OF HEARING :MAY 12, 2026TIME OF HEARING :6:00 P.M. OR SOON THEREAFTERLOCATION OF HEARING :CITY COUNCIL CHAMBER200 CIVIC CENTER, MISSION VIEJO, CA 92691 DEVELOPMENT CODE AMENDMENT P-DCA2026-0001:A City-initiated petition for consideration of an amendment to Title 9 of the Mission Viejo Municipal Code, to establish Objective Design Standards (ODS), as directed by the City Council as a Phase 2 follow-up to the Phase 1 ODS adopted by Urgency Ordinance #23-350 by the City Council on July 11, 2023, as identified in the Housing Plan of the City’s 6th Cycle (2021-2029) Housing Element. On April 13, 2026, the Planning and Transportation Commission conducted a duly and properly noticed public hearing where the Commission received public testimony, considered the proposed Development Code Amendment and oral and written public comments, and recommended the City Council consider and approve the proposed Development Code Amendment. CEQA DETERMINATION : The proposed Development Code Amendment is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15060, subd. (c)(2) because it will not result in a direct or reasonably foreseeable indirect physical change in the environment and pursuant to CEQA Guidelines section 15061, subd. (b)(3) because there is no possibility the activity in question may have a significant effect on the environment. All projects for which the Objective Design Standards would apply will undergo separate CEQA review. In addition, this ODS identification is not a “project” within the meaning of CEQA under CEQA Guidelines Section 15378 (b)(5) because CEQA does not apply to general policymaking and adoption procedure where there is no possibility that the action or activity in question will have the potential, itself, to result in a direct or reasonably foreseeable indirect physical change in the environment. INVITATION TO BE HEARD : Those persons desiring to testify in favor of or in opposition to the proposed Ordinance will be given an opportunity to do so at the public hearing. If you challenge the proposed Ordinance in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence to the City Council at, or prior to the public hearing.
