ORDINANCE NO. 6817 FIRST READING AN ORDINANCE AMENDING CHAPTER 15.04 OF THE LOVELAND MUNICIPAL CODE REGARDING BUILDINGS AND CONSTRUCTION WHEREAS, Title 15 of the Loveland Municipal Code contains the City of Loveland's building regulations. The City is in the process of amending Title 15 by adopting by reference the 2024 editions of various International Code Council codes, such as the International Building Code and International Plumbing Code (the "International Codes"); and WHEREAS, many of the International Codes contain duplicative provisions regarding administration and enforcement of such codes, and the City consolidated these provisions as much as possible within Chapter 15.04 of the Loveland Municipal Code; and WHEREAS, the proposed amendments to Chapter 15.04 will clarify permit expirations, permit transfer requirements, specialty license requirements, and appeal processes; and WHEREAS, the Construction Advisory Board has recommended that City Council adopt the proposed amendments to Chapter 15.04; and WHEREAS, the City Council desires to amend Chapter 15.04 in order to clarify permit expirations, permit transfer requirements, specialty license requirements, and appeal processes as such amendment is in the best interests of the City and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOVELAND, COLORADO: Section 1. Section 15.04.190(E) of the City of Loveland Municipal Code is deleted and replaced in its entirety as follows: E. Expiration of permits. Every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within 180 days after its issuance, or if the work authorized on the site by such permit is suspended or abandoned for a period of 180 days after the time the work is commenced. The Building Official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each, if the Building Official determines in his or her sole discretion that adequate progress is being made under the permit. The extension shall be requested in writing and justifiable cause demonstrated. In order to renew action on an expired permit the Building Official may charge an additional permit fee. Such fee shall be as established by the City Council. Both prior to and subsequent to the effective date of this section, any permit issued by the Building Official for work that involves the construction or alteration of an exterior building component, assembly, or finish material, such as the foundation, wall and roof framing, sheathing, siding, fenestration, and roof covering, shall be fully finished and completed for permanent outdoor exposure within 12 months after the issuance of the permit. Section 2. Section 15.04.190 of the City of Loveland Municipal Code is amended with the addition of subsection H, to read as follows: 15.04.190 Permits generally H. Transfer of permits. A current, valid building permit may be transferred from one party to another upon written application to the Building Official with the consent of both parties. When any changes are made to the original plans and specifications substantially differ from the plans submitted with the permit, as determined by the Building Official, a new plan check fee shall be paid. Section 3. Section 15.04.200(C) of the City of Loveland Municipal Code is deleted and replaced in its entirety as follows: 4. The following persons are exempt from the licensing requirements of this section: a. A person working under the direct supervision of any other person licensed in the relevant trade under this chapter; b. A homeowner who builds, constructs, alters, repairs, adds to or demolishes any building or structure or any portion thereof that constitutes the owner's primary residence, or a building or structure accessory thereto, and that is intended for the owner's personal use. This section shall not apply to the installation or repair of fire alarms and fire sprinklers. c. A public utility company and its employees, when engaged in the installation, operation and maintenance of its equipment used for the production, generation or distribution of the utility, product or service through the facilities owned or operated by the public utility company to the point of customer service. d. A homeowner who contracts with contractors to build, construct, alter, repair, add to or demolish any building or structure or any portion thereof that constitutes an accessory dwelling unit, as defined in Title 18, to the owner's primary residence, provided, however, the contractors the homeowner contracts with must be licensed as required by this section. Section 4. Section 15.04.200(G)(4) of the City of Loveland Municipal Code is deleted and replaced in its entirety as follows: 4. Class S, Specialty License. These licenses entitle the licensee to perform only the type or types of work described below: a. S-1: Roofing Contractor/Subcontractor. Installation and replacement of roof coverings. b. S-2: Swimming Pools and Spas. Installation of swimming pools and spas. c. S-3: Fire Alarms. Installation of fire and burglar alarms. d. S-4: Fire Suppression. Installation of fire extinguishing systems. e. S-5: Framing (F). Installation of framing. f. S-5: Solar. Installation and replacement of solar energy systems. NABCEP certification required. g. Other: The Building Official shall have the authority to grant other specialty licenses as the Building Official determines appropriate in his or her sole discretion. Section 5. Section 15.04.200(H)(3) of the City of Loveland Municipal Code is deleted and replaced in its entirety as follows: 3. Examinations are required for the following licenses: a. Standard General Building Contractor (A); b. Standard Building Contractor (B); c. Standard Residential Building Contractor (C); d. Standard Master Mechanical; e. S-1 Roofing Contractor/Subcontractor; and f. Framing (F) g. Solar (NABCEP Certified) Section 6. Section 15.04.210(A) of the City of Loveland Municipal Code is deleted and replaced in its entirety as follows: A. Basis of appeal. A person may appeal a decision or other action of the Building Official or his or her duly authorized representative or of a duly authorized code enforcement officer to the Construction Advisory Board for the following types of decisions or actions: (a) denial of a permit or certificate of occupancy; (b) revocation or suspension of a permit or certificate of occupancy; (c) issuance of an order to discontinue use and vacate; (d) notice of abatement; (e) issuance of a stop work order; (f) determination of alternative materials and methods, and (g) an order for demolition of a structure; and (h) an order for condemnation of a structure, premises, or equipment based on findings that it is unsafe, unfit for human occupancy, unlawful, or otherwise hazardous. Section 7. That if any section, subsection, or portion of this ordinance is, for any reason, held to be unconstitutional or invalid for any reason, such decision shall not affect that validity of the remaining portions of this ordinance. City Council hereby declares that it would have passed this ordinance, and each section, subsection, and portion hereof, regardless of whether any one or more sections, subsections, or portions may be declared unconstitutional or invalid. Section 8. That nothing in this ordinance shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, liability incurred, or cause of action acquired or existing under any ordinance hereby repealed, nor shall any legal right or remedy of any character be impaired by this ordinance. Section 9. That as provided in City Charter Section 4-9(a)(7), this Ordinance shall be published by title only by the City Clerk after adoption on second reading unless the Ordinance has been amended since first reading in which case the Ordinance shall be published in full or the amendments shall be published in full. This Ordinance shall be in full force and ten days after its final publication, as provided in City Charter Section 4-8(b).
