ORDINANCE NO. 6818 FIRST READING AN ORDINANCE REPEALING AND REENACTING TITLE 15.12 OF THE LOVELAND MUNICIPAL CODE AND ADOPTING BY REFERENCE THE INTERNATIONAL PROPERTY MAINTENANCE CODE, 2024 EDITION AND AMENDING CERTAIN SECTIONS OF TITLE 15.04 REGARDING APPEALS WHEREAS, pursuant to Section 4-12 of the Charter of the City of Loveland, the City Council is authorized to adopt, by ordinance, any code by reference in accordance with the procedures established by state law; and WHEREAS, City staff reviewed the 2024 Edition of the International Property Maintenance Code (the "2024 IPMC"), and, in an effort to maintain a certain level of consistency with neighboring jurisdictions, proposed similar amendments to the 2024 IPMC. The Loveland Construction Advisory Board reviewed the proposed adoption and amendments, and recommended that the City Council adopt the 2024 IPMC; and WHEREAS, the City Council introduced this ordinance on first reading pursuant to C.R.S. �31-16-203 on October 21, 2025 and plans to conduct a public hearing pursuant to the same on December 2, 2025 concerning the adoption of the 2024 IPMC by reference and finds and determines that it is necessary to the health, safety and general welfare of the public that the City regulate conditions hazardous to life and property by the adoption of the 2024 IPMC, and certain amendments and modifications thereto. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOVELAND, COLORADO: Section 1. The International Property Maintenance Code, 2024 Edition, issued and published by the International Code Council, 4051 West Flossmoor Road, Country Club Hills, IL 60478-5795, including Appendix A is hereby adopted by reference as the property maintenance code of the City. This code is a complete code to safeguard life and limb, health, property and public welfare by regulating and governing the conditions and maintenance of all property, buildings and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use, and providing for issuance of permits and collection of fees therefore. At least one copy of the International Property Maintenance Code, 2024 Edition, which has been certified by the Mayor and City Clerk, shall be on file in the office of the City Clerk and may be inspected during regular business hours. Section 2. That Section 15.12.020 of the Loveland Municipal Code which contains the City's modifications to the 2024 International Property Maintenance Code shall be amended as follows: A. Section 101.1 - Title - is amended to read as follows: These regulations shall be known as the Property Maintenance Code of the City of Loveland, hereinafter referred to as "this code" or "property maintenance code." B. Section 102.2 Maintenance is amended to read as follows: Equipment, systems, devices and safeguards required by this code or a previous regulation or code under which the structure or premises was constructed, altered or repaired shall be maintained in good working condition. An owner, owner's authorized agent, operator or occupant shall not cause any service, facility, equipment or utility that is required under this section to be removed from, shut off from or discontinued for any occupied dwelling, except for such temporary interruption as necessary while repairs or alterations are in progress. The requirements of this code are not intended to provide the basis for removal or abrogation of fire protection and safety systems and devices in existing structures. Except as otherwise specified herein, the owner or the owner's authorized agent shall be responsible for the maintenance of buildings, structures and premises. C. Section 102.3 - Application of other codes - is amended to read as follows: Repairs, additions or alterations to a structure, or changes of occupancy, shall be done in accordance with the procedures and provisions of the currently adopted building and fire codes. Nothing in this code shall be construed to cancel, modify or set aside any provision of the adopted City of Loveland Unified Development Code. D. Section 103 - Department of property maintenance inspection - is deleted in its entirety. See Loveland Municipal Code Section 15.04.070. E. Section 105.5 Notices and orders is deleted in its entirety. See Loveland Municipal Code Section 16.44.010. F. Section 105.7 Liability is deleted in its entirety. See Loveland Municipal Code Section 15.04.180. G. Section 106 Means of Appeals is deleted in its entirety. See Loveland Municipal Code Section 15.04.210 H. Section 107 Violations - is deleted in its entirety. See Loveland Municipal Code Section 15.12.030 I. Section 108 Stop work order is deleted in its entirety. See Loveland Municipal Code Section 15.04.090. J. Section 109.4 Notice is deleted in its entirety. See Loveland Municipal Code Section 16.44.010 - Notice and order to abate. K. Section 110.5 - Costs of emergency repairs is amended to read in full as follows: For the purposes of this section, the code official shall employ, or cause to be employed, the necessary labor and procure materials to perform the work required as expeditiously as possible. Costs incurred in the performance of emergency work shall be paid by the jurisdiction. The legal counsel of the jurisdiction shall institute appropriate action, including a lien upon the property, against the owner of the premises or owner's authorized agent where the unsafe structure is or was located for the recovery of such costs. L. Section 111.2 - Notices and orders is deleted in its entirety. See Loveland Municipal Code Section 16.44.010. M. Section 201.3 - Terms defined in other codes is amended to read in full as follows: Where terms are not defined in this code and are defined in the Loveland Municipal Code, the Unified Development Code and any other code adopted by reference in the Loveland Municipal Code, including International Building Code, International Existing Building Code, International Fire Code, International Fuel Gas Code, International Mechanical Code, the International Plumbing Code to the extent adopted by the Colorado Plumbing Code, International Residential Code, or NFPA 70, such terms shall have the meanings ascribed to them as stated in those codes. N. Section 202 - General definitions is amended to add the definitions of "abandoned," "good condition," "hazardous" and "vacant" as follows: ABANDONED. Any building or premises covered under this code that is unoccupied or vacant and in such a state of disrepair, lack of maintenance, or neglect as to pose a public nuisance. GOOD CONDITION. A condition that is fully functional, operational and substantially free from decay, deterioration, damage or other defects and capable of performing the tasks for which designed and in the manner intended without risk of injury or damage to persons or adjoining property resulting from detachment or failure of such elements or components thereof. HAZARDOUS. Whatever is dangerous to human life or is detrimental to the public health as determined by the code official. VACANT. The state of premises or a structure thereon being indefinitely uninhabited or unoccupied by lawfully authorized tenants, owners, and other persons. O. Section 302.2 Grading and drainage is deleted in its entirety. P. Section 302.4 Weeds is deleted in its entirety. See Loveland Municipal Code Section 16.32.020. Q. Section 304.14 - Insect screens is amended to read in full as follows: Every door, window and other outside opening required for ventilation of habitable rooms, food preparation areas, food service areas or any areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored shall be supplied with approved tightly fitting screens of minimum 16 mesh per inch (16 mesh per 25 mm), and every screen door used for insect control shall have a self-closing device in good working condition. Exception: Screens shall not be required for owner-occupied dwelling units where no rooms are leased or rented. Section 3. Loveland Municipal Code Section 15.04.210(A) - Appeals to the construction advisory board is hereby amended to read in full as follows: A. Basis of appeal. A person may appeal a decision or other action of the Building Official or his or her duly authorized representative or of a duly authorized code enforcement officer to the Construction Advisory Board for the following types of decisions or actions: (a) denial of a permit or certificate of occupancy; (b) revocation or suspension of a permit or certificate of occupancy; (c) issuance of an order to discontinue use and vacate; (d) notice of abatement; (e) issuance of a stop work order; (f) determination of alternative materials and methods; and (g) an order for demolition of a structure; and (h) an order for condemnation of a structure, premises, or equipment based on findings that it is unsafe, unfit for human occupancy, unlawful, or otherwise hazardous. Section 4. That if any section, subsection, or portion of this ordinance is, for any reason, held to be unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. City Council hereby declares that it would have passed this ordinance, and each section, subsection, and portion hereof, regardless of whether any one or more sections, subsections, or portions may be declared unconstitutional or invalid. Section 5. That nothing in this Ordinance shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, liability incurred, or cause of action acquired or existing under any ordinance hereby repealed, nor shall any legal right or remedy of any character be impaired by this ordinance. Section 6. That the City Clerk shall cause to be published twice in a newspaper of general circulation within the City, once at least fifteen days preceding the public hearing, and once at least eight days preceding the public hearing, the following notice: Public notice is hereby given that at 6:00 p.m. on June 2, 2026, in the City Council Chambers, City Hall, 500 East Third Street, Loveland, Colorado, the Loveland City Council will consider on second reading an Ordinance Repealing and Reenacting Chapter 15.12 and Adopting by Reference the International Property Maintenance Code, 2024 Edition and Amending Certain Sections of Title 15.04 Regarding Appeals. A public hearing shall be held prior to said consideration. Copies of the above-referenced International Property Maintenance Code, 2024 Edition and any codes adopted by reference within the code are on file with the Loveland City Clerk and are open to public inspection. Section 7. That copies of this Ordinance and the 2024 International Property Maintenance Code shall be kept on file with the Loveland City Clerk and are open to public inspection. Section 8. That as provided in City Charter Section 4-9(a)(7), this Ordinance shall be published by title only by the City Clerk after adoption on second reading unless the Ordinance has been amended since first reading in which case the Ordinance shall be published in full or the amendments shall be published in full. This Ordinance shall be in full force and effect ten days after its final publication, as provided in City Charter Section 4-8(b).
