ADOPTION OF ORDINANCES
Notice is hereby given that the City Commission, City of New Smyrna Beach, will conduct public hearings for consideration of adoption of the following ordinances on Tuesday, May 26, 2026, at the regular City Commission meeting starting at 5:30 p.m., in the City Commission Chambers, 214 Sams Avenue, New Smyrna Beach, Florida:
Copies of the ordinances may be obtained by mail or inspected in person at the Office of the City Clerk, 210 Sams Avenue, New Smyrna Beach, Florida 32168, Telephone (386) 410-2630.
Pursuant to Sec. 166.041(3)(a), F.S., all interested persons may appear and be heard with respect to the proposed ordinances.
ORDINANCE NO. 27-26
AN ORDINANCE OF THE CITY OF NEW SMYRNA BEACH AMENDING THE LAND DEVELOPMENT REGULATIONS; AMENDING ARTICLE VIII, SUPPLEMENTARY REGULATIONS, SECTION 803.03 TO CLARIFY REGULATIONS FOR HEDGES AND TO REVISE VISIBILITY TRIANGLE REGULATIONS; AMENDING SECTION 803.05 TO PROVIDE REGULATIONS FOR POOL PUMPS AND HEATERS; AMENDING SECTION 804.03 TO REMOVE REDUCED SETBACKS FOR POOLS AND DECKS; PROVIDING FOR CODIFICATION; PROVIDING FOR PUBLIC HEARING; PROVIDING FOR CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
ORDINANCE NO. 28-26
AN ORDINANCE OF THE CITY OF NEW SMYRNA BEACH AMENDING THE LAND DEVELOPMENT REGULATIONS; AMENDING ARTICLE III, ADMINISTRATION AND ENFORCEMENT, SECTION 305.05, VARIANCE, TO REVISE THE PERCENTAGE OF ALLOWABLE ADMINISTRATIVE VARIANCE TO SETBACKS FOR CONSISTENCY; PROVIDING FOR CODIFICATION; PROVIDING FOR PUBLIC HEARING; PROVIDING FOR CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
RECORD IS REQUIRED TO APPEAL
Pursuant to Sec. 286.0105, F.S., if any person decides to appeal any decision made by the City Commission at this public meeting, the person will need a record of the proceedings and for such purposes may need to ensure that a verbatim record of the proceedings is made, including the testimony and evidence upon which the appeal is to be based.
