NOTICE OF INTENTION TO
APPLY TO THE BOARD OF COUNTY COMMISSIONERS TO VACATE AND CLOSE A PORTION OF PLATTED UTLITY EASEMENT AS SHOWN ON THE PLAT OF SHADOW WOOD, UNIT 2, WINTER HAVEN, POLK COUNTY, FLORIDA.
TO WHOM IT MAY CONCERN:
Notice is hereby given that the Board of County Commissioners of Polk County, Florida, upon petition of Brion Babula Sr. and Janet F. Babula will, at 9:00 a.m., or shortly thereafter, on the 2nd day of June, in the Board Room of the Polk County Administration Building, 330 West Church Street, Bartow, Florida, consider and determine whether or not the County will vacate, abandon, discontinue, and close a portion of a platted utility easement as shown on the Plat of Shadow Wood, Unit 2, Polk County, Florida, described as:
THE PLATTED 7.5-FOOT-WIDE UTILITY EASEMENT THAT LIES ALONG THE SOUTHEASTERLY SIDE OF LOTS 5, 6, AND 7, AND THE PLATTED 7.5-FOOT-WIDE UTILITY EASEMENT THAT LIES ALONG THE NORTHWESTERLY SIDE OF LOTS 19, 20, 21, 22, 23, AND 24, OF SHADOW WOOD, UNIT 2, AS RECORDED IN PLAT BOOK 68, PAGE 28, PUBLIC RECORDS OF POLK COUNTY, FLORIDA.
And renounce and disclaim any right of the County and the public in and to said portion of easement/right of way and the land in connection therewith. Persons interested may appear and be heard at the time and place above specified.
Should any person decide to appeal any decision made by the Board at this meeting, he/she will need a record of the proceedings, and he/she may need to ensure that a verbatim record of these proceedings is made.
