STATE OF NEW JERSEY DEPARTMENT OF LAW AND PUBLIC SAFETY DEVISION OF ALCOHOLIC BEVERAGE CONTROL LICENSE NO. 0714-44-514-003 DOCKET NO. 03-26-15 JOB NO. 849202 IN THE MATTER OF THE APPLICATION TO) PERMIT THE RENEWAL OF AN INACTIVE) SPECIAL RULING LICENSE PURSUANT TO N.J.S.A. 33:1-12.18) FOR THE 2025-2026 LICENSE TERM(S)) WILLIAM H BUSH William Bush, Pro se; BY THE DIRECTOR: License renewal applications must be filed prior to the commencement of a new license term or not later than thirty days after the commencement thereof. N.J.S.A. 33:1-12.18. When timely renewal is not filed, the license may petition for the issuance of a "new license" pursuant to N.J.S.A. 33:1-12.18. The renewal application must be filed, and the municipal and State renewal fees paid, within one (1) year of the year following expiration of the license. Thereafter, the directory may authorize the issuance of a "new license," if he determines that the applicant's failure to timely apply was due to circumstances beyond his or her control or other extraordinary circumstances. In this case, on December 31, 2025, the licensee paid the municipal fee, submitted the renewal application, and State fee to the City of Newark. The verified petition and filing fee were submitted in March 2026. Thus, the license requires relief pursuant to N.J.S.A. 33:1-12.18. In the verified petition, the licensee states that he could no longer operate because the property was subject to foreclosure. Further, due to financial difficulties, he was unable to pay the renewal fee on time. All fees have now been paid. Based on the foregoing, I find that the licensee demonstrated circumstances beyond his/her control. Therefore, I shall GRANT the relief sought in the verified petition. Thereafter, the local issuing authority may consider the application for a new license and grant or deny said application in the reasonable exercise of its discretion. 4/13/2026 $190.46
