New York State Department of Environmental Conservation Notice of Complete Application Date: 02/13/2026 Applicant: NEW YORK STATE ELECTRIC & GAS CORPORATION 18 LINK DR PO BOX 5224 BINGHAMTON, NY 13904-5224 Facility: BES Fraser 115kV Reroutes Located within utility right-of-way Delhi;hamden, NY Application ID: 4-1299-00069/00002 Permits(s) Applied for: 1 - Article 17 Titles 7 & 8 P/C/I SPDES - Surface Discharge Project is located: In MULTIPLE TOWNS in DELAWARE COUNTY Project Description: The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve a proposed stormwater discharge to surface waters of the State from the construction of 50 new electrical transmission structures and the modification of four existing structures, along with the construction of stabilized construction entrances and approximately 1.74 miles of temporary access roads. The proposed project will disturb approximately 34.3 acres of a 49-acre work area, with no more than 4.9 acres of soil to be disturbed at any one time. The proposed project involves the installation of new utility structures to support approximately 3.5 miles of new 46 kV electrical transmission line within a roughly 100- foot-wide right of way in the Town of Delhi. The line will extend from the Fraser Substation to just northeast of Holmes Hollow Road, running alongside an existing overhead transmission right-of-way until it reaches the Delhi Co op Tap. The construction project is ineligible for coverage under the SPDES General Permit for Stormwater Discharges from Construction Activities because it is a linear project that is within the watershed of surface waters of the State classified as AA identified utilizing the Stormwater Interactive Map on NYSDEC’s website; and will be undertaken on land with no existing impervious cover; and will disturb two or more acres of steep slope. The draft permit files are contained within regional folders and named by the SPDES number contained in this notice. Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. Refer to this application by the application number listed above and SPDES Number NY0305227 Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person. State Environmental Quality Review (SEQR) Determination Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other involved agencies was performed and a Negative Declaration is on file. SEQR Lead Agency Delhi Town Planning Board State Historic Preservation Act (SHPA) Determination Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures. DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29) It has been determined that the proposed action is not subject to CP-29.
