TOWN OF GENESEO, STATE OF NEW YORK

LEGAL NOTICE OF TOWN OF GENESEO TOWN BOARD MEETINGPROPOSED LOCAL LAW #1 OF 2026: REPEALING LOCAL LAW NO. 3 OF 2021 AND OPTING-IN TO ALLOW ADULT USE CANNABIS RETAIL DISPENSARIES WITHIN THE TOWN OF GENESEO, NEW YORK

PLEASE TAKE NOTICE that the Town Board of the Town of Geneseo, New York will hold a public hearing pursuant to Municipal Home Rule Law Section 20 and Town Law on a proposed local law entitled "A Local Law to Repeal Local Law No. 3 of 2021 Opting Out of Adult-Use Cannabis Retail Dispensary Licensing and Operation, to Opt Into Adult-Use Cannabis Retail Dispensary Licensing and Operation, and to Amend the Zoning Code to Address Adult-Use Cannabis Retail Dispensaries."

PLEASE TAKE FURTHER NOTICE that the proposed local law would: (1) repeal the Town's prior local law that opted out of allowing adult-use cannabis retail dispensaries within the Town; (2) affirmatively opt into allowing the licensing and operation of adult-use cannabis retail dispensaries within the Town; and (3) amend the Town's zoning code to establish one or more zoning districts, regulations, and restrictions applicable to adult-use cannabis retail dispensaries, including but not limited to permitted locations, setback requirements, operational standards, and other land use controls. The Local Law proposes to authorize Licensed Cannabis Retailed Dispensaries as a use permitted by special use permit in the Town’s General Commercial (GC) zoning district (Town Code §106-21.6) subject to the same bulk and area restrictions as a “Banquet/Wedding facility” use as such uses are set forth in Attachment # 7 to Town Zoning Code Section 106, as revised.

PLEASE TAKE FURTHER NOTICE that said public hearing will be held by the Town Board of the Town of Geneseo, in the County of Livingston, in the State of New York, at the Town of Geneseo offices located at 4630 Millennium Drive, Geneseo, New York 14454 at 4:45 PM on March 11, 2026, at which time and place all persons interested will have an opportunity to be heard concerning said proposed local law.

PLEASE TAKE FURTHER NOTICE that copies of the proposed local law are available for inspection and copying during regular business hours at the Office of the Town Clerk, located at 4630 Millennium Drive, Geneseo, New York.

Any person may appear and be heard at the aforesaid public hearing in person or by agent or attorney. Written comments may be submitted prior to or at the public hearing.
