Pursuant to the provisions of General Municipal Law and Chapter 200 of the Code of the Incorporated Village of Garden City, New York notice is hereby given that the Board of Appeals of said Village will meet in the Village Hall at 351 Stewart Avenue, Garden City, New York on Tuesday, May 19, 2026 , at 6:30 p.m. , to take action on the following matters:
1. APPLICATION & APPEAL OF MICHAEL & KATHRYN RAFFERTY , in accordance with the provisions of Village Code Section 200-16.A ( 9 . d , and a variance from section 200-45.H , for permission to apply for permits, to construct and maintain an 8’ x 8’ in-ground spa w/ automatic cover, enclosed by 6 ’ fence, in the rear yard of the premises known as 64 SECOND STREET (Map of Garden City Central, Block 28, Lot 5, R-20 district), the granting or which would:

2. 7. APPEAL OF KEVIN & JENNIFER MARTIN for a variance of the provisions of Village code section 200-52 . H , to allow for the issue of permits, for the maintenance of a previously installed split system condenser in the side yard; at the premises known as 121 TULLAMORE ROAD (Map of Country Club Estates, Block 4, Lot 54, R-6 District), the granting of which has:
A. reduced the 10.0’ required setback for freestanding primary equipment, to not less than 6.0’.

A . reduce the 10 . 0 ’ plot line setback for freestanding A / C equipment,
to not less than 6 . 0 ’.

APPEAL OF WAG IN PEACE, INC. in accordance with the provisions of Sections 200-7 , and 200-65 for variances from Village Code sections 200-29 and 200-39 , so as to permit the use of the existing warehouse building, as an alkaline hydrolysis animal cremation facility, at the premises known as 64 COMMERCIAL AVENUE (Map of Descriptive, Block D, Lot 19) which would:
A . cause industrial use in a C- S District ~
B . cause a mortuary, undertaking or embalming parlor or similar establishment to be less than 500 feet from a dwelling.
