TRUSTEE'S SALE OF VALUABLE CONDOMINIUM UNIT 101, CONTAINED WITHIN PREMISES of The Warder Condominium, 3542 Warder Street, NW, Unit 101, Washington, DC 20010. Pursuant to the District of Columbia Condominium Act of 1976, as amended, the Condominium Declaration recorded on August 17, 2016 as Instrument No.2016084152, and the Bylaws relating thereto recorded on August 17, 2016 as Instrument No.2016084153 among the Land Records of the District of Columbia, and any recorded amendments thereto as of the date hereof, and pursuant to D.C. Code Section 42-1903.13, establishing that the Executive Officer shall be the Trustee to conduct the foreclosure sale, notice was filed on April 17, 2026. The Trustee shall sell at public auction on Wednesday, May 20, 2026 at 12:00 P.M., at the office of ALEX COOPER AUCTIONEERS, INC., 4910 Massachusetts Avenue, NW, Suite 100, Washington, DC 20016, the following described premises situated in the District of Columbia:
Part of Lot 83 in Square 3037 in a subdivision made by Warder Condos LLC, as per plat recorded in Liber No. 208 at folio 135 in the Records of the Office of the Surveyor for the District of Columbia.
Part of land conveyed being more particularly designated as UNIT NO.101 of "The Warder Condominium", according to the Declaration of Condominium recorded August 17, 2016, as Instrument No. 2016084152 and the Bylaws of The Warder Condominium relating thereto recorded August 17, 2016, as Instrument No. 2016084153 among the Land Records of the District of Columbia, and as per plat of Condominium subdivision recorded in Condominium Book No. 92 at Page 21 in the Office of the Surveyor for the District of Columbia.
At the date hereof the above-described land is designated on the Records of the Assessor of the District of Columbia for assessment and taxation purposes as Lot 2001 in Square 3037.
TOGETHER WITH all of the appurtenances incident to said Unit, as contained in said Declaration of Condominium.
SUBJECT, HOWEVER, to all the provisions, restrictions, easements and conditions, as contained in said Declaration of Condominium and the Bylaws relating thereto. The Condominium Declaration allocates to the Condominium Unit an undivided interest (stated as a percentage) in the common elements of the Condominium. The Percentage Interest of the Condominium Unit is set forth in Exhibit B to the Condominium Declaration, as amended.
TERMS OF SALE: Sold subject to real estate taxes, and subject to other superior liens, encumbrances and municipal assessments, if any. The Association is foreclosing on six-month super priority lien. Other oral information regarding 3542 Warder Street, NW, Unit 101 may be disclosed at the time of the sale. A deposit of $10,000.00 shall be required at time of sale and such deposit shall be a certified check, cashier's check, or in such other form as the Association, in its sole discretion, requires. All conveyancing, recording, recordation tax, transfer tax etc. shall be at the purchaser's sole expense.
The balance of the purchase price, together with interest at the rate of 10% per annum from date of sale to date of receipt of the balance of the purchase price, must be paid by cashier's check or certified check, and all other terms shall be complied with within 30 days. Otherwise, the deposit is forfeited and the property may be re-advertised and resold at the discretion of the Trustee and at the risk and cost of the defaulting purchaser. The Trustee shall convey a deed pursuant to D.C. Code Section 42-1903.13, and makes no further representations or warranties as to title. The Trustee cannot guarantee clear title or the purchaser's ability to obtain title insurance. For this reason, the purchaser may not be able to obtain financing but must be able to pay the entire purchase price balance, in any case, within 30 days from the date of auction. In the event of the failure on the part of the Trustee to convey such deed for any reason, the purchaser's sole remedy shall be the return of the deposit.
