CITY OF SAN JUAN CAPISTRANOADOPTION OF AN ORDINANCE
Notice is hereby given that on May 5, 2026, the City Council adopted Ordinance 1135 entitled:
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING CODE AMENDMENT (CA) 25-004 TO AMEND MUNICIPAL CODE SECTIONS 7-8.06, 9-2.303, 9-2.317, 9-2.347, 9-3.507; 9-3.533, 9-3.553, TITLE 9 TABLES 3-4, 3-6, 3-8, 3-10, 3-12, 3-14, AND 3-15, TO COMPREHENSIVELY UPDATE THE CITY’S ANTENNAS AND WIRELESS FACILITIES STANDARDS TO ENSURE THE CITY’ REGULATIONS THAT GOVERN THE PLACEMENT OF ANTENNAS AND WIRELESS FACILITIES ON CITY AND PRIVATE PROPERTY ARE CONSISTENT WITH STATE AND FEDERAL REGULATIONS; AND A FINDING THAT SAID ACTION IS NOT A “PROJECT” AS DEFINED UNDER STATE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) GUIDELINES SECTION 15060(c)(3), AND IF IT WERE, IT WOULD BE CATEGORICALLY EXEMPT PER STATE CEQA GUIDELINES SECTIONS 15061(b)(3) AND 15320.
This ordinance updates and streamlines the City’s regulations for wireless facilities in light of numerous federal and state laws and regulations, which among other things significantly restrict local control over the permitting and placement of wireless facilities. Staff proposed several code amendments, collectively identified as Code Amendment 25-004, which constitute a comprehensive update to the Antennas and Wireless Facilities section of the City’s Land Use Code. Staff believes that all the necessary findings of fact for approval of the proposed Code Amendment can be made. On February 11, 2026, the Planning Commission considered the proposed Code Amendment and adopted a resolution recommending that the City Council approve Code Amendment 25-004.
