Repeal of Article X Opt-Out Exemption for Certain Energy Systems

(220-42, 220-43 and 220-44) of the Town of Cheektowaga Taxation Law

WHEREAS, the Town of Cheektowaga, on May 13, 2025, adopted Article X Opt-Out Exemption for Certain Energy Systems (220-42, 220-43 and 220-44) of the Town Taxation Law , AND

WHEREAS, the Cheektowaga Town Board has recommended that this law be repealed, AND

WHEREAS, in accordance with the provisions of Section 130 of the Town Law of the State of New York, a public hearing was held on the 14th day of April, 2026 at 5:30 P.M. at a meeting of the Town Board at the Cheektowaga Town Hall, 3301 Broadway, Cheektowaga, New York 14227, at which hearing all parties in interest and citizens had an opportunity to be heard as to whether Article X Opt-Out Exemption for Certain Energy Systems (220-42, 220-43 and 220-44) of the Town Taxation Law of the Code of the Town of Cheektowaga shall be repealed in its entirety, AND

WHEREAS, it is in the public interest to repeal the aforesaid Taxation Law in its entirety, NOW, THEREFORE, BE IT

RESOLVED, that Article X Opt-Out Exemption for Certain Energy Systems (220-42, 220-43 and 220-44) of the Town Taxation Law of the Code of the Town of Cheektowaga be and hereby is repealed in its entirety, and BE IT FURTHER

RESOLVED, that the aforementioned repeal of Article X Opt-Out Exemption for Certain Energy Systems (220-42, 220-43 and 220-44) of the Town Taxation Law of the Code of the Town of Cheektowaga shall take effect immediately.
