BEFORE THE CITY COUNCIL OF THE CITY OF CONCORD COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA Adoption of a Resolution of Intention to Order Improvements, Levy and Collect Assessments, and Set a Public Hearing for the Downtown Landscape Maintenance District / Resolution No. 26-23 WHEREAS, the Downtown Landscape Maintenance District was created on November 14, 1983, by the adoption of Resolution No. 83-132; and WHEREAS, pursuant to the provisions of the Landscape and Lighting Act of 1972 (Streets and Highways Code 22500 et seq.), the City must follow certain steps in order to levy an annual assessment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CONCORD DOES RESOLVE AS FOLLOWS: Section 1. The foregoing recitals are incorporated by reference. Pursuant to the California Environmental Quality Act of 1970, Public Resources Code �21000, et seq., as amended and implementing State CEQA Guidelines, Title 14, Chapter 3 of the California Code of Regulations (collectively, "CEQA"), these activities do not constitute a "project" within the meaning of Public Resources Code Section 21065, 14 Cal Code Reg. Section 15060(c)(2), 15060(c)(3), 15273, and/or 15378 because it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment and/or because it involves government funding/fiscal activities. In addition, the Amendment is categorically exempt pursuant to Section 15061(b)(3), "Review for Exemptions" of the CEQA Guidelines because there is no possibility that these activities may have a significant effect on the environment, and no further environmental review is required. No unusual circumstances are present. This determination reflects the City's independent judgment and analysis. Section 2. The City Council intends to levy and collect assessments within the Downtown Landscape Maintenance District during the Fiscal Year 2026/2027. The amount of the proposed assessment for Fiscal Year 2026/2027 is $519,152. The assessment for Fiscal Year 2026/2027 depends on each parcel's square footage, street frontage, and respective benefit zone. The purpose of the assessment is for the maintenance of landscaping in the Concord downtown area. The area of land to be assessed is located within Concord downtown area, which is within the boundaries of the City of Concord, County of Contra Costa. Section 3. The improvements within said district include: the installation or planting of landscaping; the installation of landscaping and park and recreational improvements; the construction of any facilities which are necessary or convenient for the maintenance or servicing thereof; and the maintenance or servicing of any of the foregoing. No substantial changes are proposed to be made to the existing improvements. Section 4. The Preliminary Engineer's Report has been filed with the City Clerk and accepted by the City Council. All interested persons are referred to that report for a full and detailed description of the improvements, the properties to be assessed and the proposed assessments upon assessable lots and parcels of land within the assessment district. Section 5. All interested parties may contact Jeff Rayos, Administrative Services Manager, at (925) 671-3446 for additional information about the assessment. Section 6. Property owners may mail a written protest against the assessment to the Office of the City Clerk at 1950 Parkside Drive, MS/03, Concord, California 94519-2578. Section 7. On Tuesday, May 26, 2026, the City Council will conduct a public hearing on the question of the levy of the proposed assessment. The hearing will be held at 6:30 p.m. in the City Council Chambers located at 1950 Parkside Drive, Concord, California and remotely via Zoom. Section 8. The City Clerk is authorized and directed to publish this notice of public hearing by publication of this resolution, as required by the Landscape and Lighting Act of 1972. Section 9. This resolution shall become effective immediately upon its passage and adoption.
