NOTICE OF SOLICITATION The CITY OF OAKLAND, acting by and through its BOARD OF PORT COMMISSIONERS, will receive Bids per the provisions of Document 00200, Instructions to Bidders, Paragraph 19, Bid Submission, until 12:00 noon on Monday, June 22, 2026, for the following Project: BERTH 24 BACKLANDS REDEVELOPMENT PROJECT MARAD FY 2022 PIDP GRANT NO. 693JF72344018 Refer to Document 00200 for required documents and items to be included in the Bid. The work of this 548 calendar day project consists, in general, of furnishing all labor, materials, appliances, tools, equipment, transportation, services and supervision required to construct the backlands improvements at Berth 24, including, but not limited to: site preparation, site paving and striping, drainage, installation of bioretention, new switchgear, reefer racks, RTG runways, underground conduits, vaults, cabling, light poles, and firewater; and performing all associated work, all in accordance with the Contract Documents. The Engineer's estimate for this project is $64,000,000. A California Class A contractor's license is required prior to award of this Contract. Joint ventures must secure a joint venture license prior to award of this Contract. No contractor or subcontractor may be listed on a bid proposal or awarded any contract for the project unless registered with the Department of Industrial Relations (DIR) pursuant to Labor Code section 1725.5, with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a). This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. Effective January 1, 2024, amendments to California Air Resources Board (CARB) In-Use Off-Road Diesel-Fueled Fleets Regulation require the Port to obtain valid Certificates of Reported Compliance (CRC) from all contractors and listed subcontractors before awarding the Project. Bidders must submit the required CRCs as provided in Document 00200, Instructions to Bidders. A Performance Bond and a Payment Bond are required for this contract. The Contractor and all subcontractors shall pay their employees in the performance of labor under this Contract salaries or wages at least equal to the general prevailing wage rates, as determined by the Secretary of Labor, United States Department of Labor, or by the Director of the Department of Industrial Relations of the State of California, whichever is higher, for the particular crafts, classifications or types of workers employed on the project, which are in effect at the time of advertising for bids, subject to compliance with the Port of Oakland Maritime and Aviation Project Labor Agreement (MAPLA). This Project is federally assisted by the U.S. Department of Transportation, Marine Administration (MARAD) through Grant No. 693JF72344018, which is governed by Grant Agreement Under the Fiscal Year 2022 Port Infrastructure Development Program (PIDP) MARAD FY 2022 PIDP Grant No. 693JF72344018 (2022 PIDP Grant Agreement). The Contractor shall be subject to and must comply with the terms of the 2022 PIDP Grant Agreement (which includes the U.S. Department of Transportation Maritime Administration General Terms and Conditions Under the Fiscal Year 2022 Port Infrastructure Development Program Grants, dated April 21, 2025 (General Terms and Conditions), and Exhibits referenced and incorporated therein), 2 C.F.R. Parts 200 and 1201, and all applicable federal laws, regulations, executive orders, policies, guidelines, and requirements as they relate to the application, acceptance, and use of federal funds. Federal requirements are contained in, but not limited to, Documents 00483 Federal Certifications and Disclosures, 00803 Federal Contract Provisions MARAD 2022 PIDP and 00865 Department of Labor Wage Rates. The Port will reject as non-responsive any Bid submitted without the Document 00483 Federal Certification and Disclosure. Further to General Terms and Conditions, section 13.3 and 2 C.F.R. 200.321, when procuring Subcontractors, Contractor must take all necessary affirmative steps pursuant to 2 CFR � 200.321(b), subject to the limitations of law, to ensure that minority businesses, women's business enterprises, veteran-owned business, and labor surplus area firms are used when possible. The successful Bidder, whether union or non-union, must comply with the provisions of Document 00823, Port of Oakland Maritime and Aviation Project Labor Agreement (MAPLA) and Amendments, and must execute Document 00630R1, Letter of Assent [2016] V.1. Non-union Bidders and Bidder's subcontractors are not required to sign union agreements nor are their employees required to become union members to perform work on this project. This Project will be covered by the Port's Owner Controlled Insurance Program (OCIP). The OCIP will provide the General Liability, Worker's Compensation, Employer's Liability, and Contractor's Pollution Legal Liability insurance. The OCIP Administrator for the project will be Alliant Insurance Services ("Alliant"). The Contractor will be required to provide Builder's Risk Insurance, Automotive Liability Insurance for Contractor's vehicles and equipment, and other coverages as more specifically described in Article 4, Bonds and Insurance, of Document 00700, General Conditions. The work of this project is subject to the City of Oakland's Construction and Demolition Debris Waste Reduction and Recycling Program requirements. The Port will permit the successful Bidder to substitute securities for retention monies withheld to ensure performance of the contract, as set forth in Document 00680, Escrow Agreement for Security Deposits in Lieu of Retention, in accordance with Section 22300 of the California Public Contract Code. The Port will conduct a pre-bid meeting at 1:30 p.m. on Tuesday, May 26, 2026, in the Exhibit Room on the First Floor of the Port of Oakland Building, 530 Water Street, Oakland, California. The Port strongly recommends that potential Bidders attend the pre-bid meeting. The meeting will last approximately one hour, and will address insurance requirements, bonds, Maritime and Aviation Project Labor Agreement, and any other special working conditions for this contract. The Port will conduct a site tour immediately following the pre-bid meeting. Participants should meet at 530 Water Street, Oakland, California. Bidders who wish to participate in the site tour must notify Isaac Carnegie at icarnegie@portoakland.com no later than 9:00 a.m. on May 20, 2026, to confirm. The Port will not take questions during the site tour; any questions should be emailed to the Project Engineer following the tour. The Port will provide its responses to any such questions via the Log of Responses to Bidder Questions. Any Addenda modifying the Plans and Project Manual will be posted at the same location. Pursuant to Chapter 5.12 of the Port's Administrative Code, the Port of Oakland Standard Contract Provisions (February 2015 edition) are incorporated by reference into Project Manuals issued by the Port for public works construction projects.
