Reaffirmation of Previous Environmental Assessment b. Development Agreement Amendment The project proposal is to amend the Vandengate Development Agreement (DA) to remove a requirement to pay a Community Benefit Contribution (CBC) fee of $8,370 (2018) for each single-family home proposed within the Vandengate Subdivision. Originally, adopted by City Council on September 25, 2018, by Ordinance No. 1930, the Vandengate DA included a CBC fee to pay for the construction of the Southtown Fire Station No. 75 and/or equipment for that station, and then for other capital improvements and/or acquisition of lands that the City Council considers to be of community-wide benefit. In October 2020, the City repaid all construction loan costs associated with the fire station. On June 28, 2022, the City Council adopted the City's current Development Impact Fee Program (Resolution No. 2022-059) and directed city staff to discontinue collection of all CBC fees from any active DAs. In 2022 and 2023, the City amended various other DAs through administrative procedures allowed by each DA. However, pursuant to Section 16.D of the Vandengate DA, any amendment involving monetary exactions shall not be considered administratively and must be considered by the original decision-makers for the project. Therefore, as directed by City Council, staff is pursuing an amendment to the DA to remove the CBC requirement. The Vandengate Subdivision consists of 42 lots for single-family residential development that will be comprised of market-rate for-sale housing products. The Vandengate DA was approved with a 10-year term ending on October 26, 2028. All other terms in the Vandengate DA would remain in effect. Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15162, the project impacts fall within the scope of the Vandengate Mitigated Negative Declaration (State Clearinghouse Number 2017082003).
